With other students enrolled while actually being CHARGED, this looks like a big problem to me. If VP ends up being cleared and I am his lawyer, I am suing the pants off the university. I hope that doesn't happen because it will bring unwanted attention to UT. But, unless they can come up with something (like charges) to make this stick, they deserve it. A classic case of succumbing to our over reactive society. We still truly don't know the story. But, if he is innocent, they have ruined his career and chances for a NFL opportunity. Do you really think he is just gonna say "no worries" and move on? If he does, God bless him.

If Von's attorney feel like he has been done wrong, then why not file a suit? A suit would get some answers.

I have to wonder why he has not already filed?

Maybe that would agitate the situation even more. He's in the press, hoping that public pressure will force them to speed things up.

I don't know about that, it is certainly a component but there is a whole lot of stuff to this one and some of it is just flat out bizarre.

Maybe because any civil suit would come to trial in 2016 or 2017...does him no good in the short term.

Much much less likely to clear vp with them snooping around.

Athletic department/schools much more conservative when that fear is watching over

The DA's office has nothing to do with it until that case file is turned over for review. If the KPD has still not turned it over, then you're attacking the wrong group. If they turned it over in the last month, you're attacking the wrong group.

First, Male or Female has no relevance. Just change the He to a She.

Second, if it hasn't been turned over to the DA at this point then one could assume it has not met the elements of proof because no one has been charged. If it has been turned over then one must be concerned with the right to a timely trial. Should have been on the docket.

Best guess is that the KPD and the DA are passing this case back and forth like a Hot Potato.

I am attacking both groups because it is in silent death mode and the title IX review board will not make any ruling until one of these elements make a move.

If they go to the police, they usually have a good reason for doing so because why would anyone go through the whole investigatory process otherwise? Also, the university and the police have different objectives and different standards of proof, so of course a person may not be prosecuted for lack of sufficient proof or other reasons, but the university can still mete out punishment such as a suspension. Perhaps this has all been hashed out previously in this very long thread...It is the same difficulty that the pro teams or leagues can find themselves in when a guy is very likely to have done something wrong but investigators end up not charging him with a crime--I think Greg Hardy is an example, and there are many others. Hardy was not prosecuted--as I recall because a woman decided not to press charges or somesuch--but he was still suspended by the NFL, for 10 games now reduced to 4. These cases are complicated--and we are, rightly, in an environment where any charge of sexual assault is going to be treated very seriously.

Pearson was reinstated on May 4th by Dean Dr Maxine Davis who was a former Dean of Students and is now the assistant Vice Chancellor for student life but that decision was over ruled by this guy...

Mr Carilli did not attend the hearing with Von and his attorney but over ruled it none the less. He is a Pennsylvania native, and was just hired by Jimmy Cheek in 2014. Wonder if Franklin has a plant? Let the debate..

The rape kit test for the alleged victim in a case involving suspended Tennessee football player Von Pearson has been turned over to the University of Tennessee, according to Pearson’s attorney, Chris Coffey.

“We provided the University of Tennessee with the rape kit test results for their consideration (on Thursday),’’ Coffey told Sports Radio WNML on Tuesday afternoon.

While Coffey declined to disclose the results of the test, it would make sense that the results are negative, otherwise the defense attorney would not provide them to UT.

Coffey has been frustrated on several accounts regarding Pearson, who has not been charged but was listed as a suspect in a reported rape that occurred April 24.

Coffey said the investigation has taken an unusually long time.

He also said Pearson was reinstated May 4 at a hearing before Dean Dr. Maxine Davis, assistant vice chancellor for student life. Two days later, Coffey said, Dean of Student Life Vince Carilli overturned Davis’ ruling even though Carilli was not present at the hearing.

Coffey said he asked Carilli for the basis of the overturn, and Carilli referred Coffey to UT’s general counsel. Coffey said he has not received an explanation from UT’s general counsel.

Coffey also feels some student-athletes are not treated equally.

For example, Pearson, who has not been charged, is on “interim suspension’’ yet former football player Michael Williams, who was indicted in February on two counts of aggravated rape, is enrolled in summer school.

And former Vol A.J. Johnson, who was suspended within days after being a suspect in a rape allegation in November, remained in school and graduated a few weeks later. Johnson was later charged with two counts of aggravated rape in the same case involving Williams.

“It begs the question,’’ Coffey said, “why was Pearson not allowed on campus due to an interim suspension when he hasn’t been charged when other guys who have been charged were never suspended from school and are still on campus?’’

Whether Pearson plays football at UT again remains in limbo.

The first day of classes is Aug. 19. It is not known what the deadline is for lifting the suspension and allowing him to enroll.

I just meant an organization historically known for standing up for peoples civil liberties might actually be hindering a young man who has not been arrested or charged with a crime from getting enrolled in school. That is what I meant by ironic.
