There sure is a lot of speculation going on here without one shread of fact! Jumping on the "let's blame law enforcement"may be politically correct and trendy but just like the other national cases please quit jumping to conclusions. There are other parts to this that MAY be causing the "wheels of justice to run slow." Last time I checked our criminal justice system, the District Attorney General is the person who prefers charges in a state level criminal case.

There could be numerous legitimate reasons why it is going slow! Please get off the law enforcement bashing or go get a job with Feds or in Baltimore! See how that works out for you!
 
Butch is between a rock and a hard place. If he reinstated VP, before being criminally cleared, the media would trash the him and the university. But, if it turns out that VP is never reinstated, but is later cleared, the fans will be upset. While I believe in "innocent until proven guilty", I can see why CBJ is treating the matter the way he is. His first obligation is to protect the university. He knows we are on the way up, and is trying to do everything he can to keep that momentum going. But, the only way CBJ doesn't lose in this situation, is if VP is charged.

Nailed it. Now if we can just shut down all this chatter until something concrete develops!

Let's NOT try and be like Florida State and get these things dismissed overnight as someone suggested. I sincerely hope that VP is innocent, however, pretend for just a second that you have a daughter, and that was her, and he isn't innocent. You may not like looking at this through a "Free Shoes U" prism.

I agree. No one here wants to think about the external factors that could be getting in Law Enforcement's way. There are a lot of possibilities. For instance, I heard that Krispy Kreme did away with their police discount, so the police have to figure out where to go for donuts now before they can worry about any investigating. Then when you consider the 4th of July cookout they've probably been planning since May and all the 20 year olds throwing drinking parties they've got to worry about, it's easy to see why KPD could have their hands tied here.

I would bet the girl is also wondering what the hold up is - If this really happened (and thats IF) would you want the guy walking around free this long, if you were her ?

Can someone tell me what they mean by "Right to a speedy trial"? Do not get me wrong, if he did something wrong, he needs to be held responsible, but this is ridiculous.

He hasn't been charged with anything so there is no speedy trial issue, BUT the bigger problem that most posters seem to ignore is that there is a Title IX issue that the university has to deal with before he can be allowed to participate, even if no charges are ever brought. I suspect that that investigation is what is causing the delays, not KPD or the DA's office.

Rape/Sexual assault is an incredibly difficult crime to prosecute. He's innocent until proven guilty, so they can't just throw him in jail to rot until they get enough evidence to put him on trial.
 
Not entirely accurate.

Part of the delay in the AJ Johnson case was the fact that the incident happened at year end, where you deal with Holidays and a new Grand Jury being seated in January. If I'm not mistaken the DA waited until January since they knew a new GJ would be in place. And that's not early January either.

FWIW the beat writers all seem to think Pearson is reinstated unless something new comes out.

We will find out come the first week of August.

As for the beat writers I believe those same beat writers said the same thing about AJ when all of that first went down, look where that went.

Rape/Sexual assault is an incredibly difficult crime to prosecute. He's innocent until proven guilty, so they can't just throw him in jail to rot until they get enough evidence to put him on trial.

No, he's being punished over an allegation. Stick to the facts please.

No, they'll just suspend him from the team indefinitely, destroying his career in the process all in the name of an allegation with no actual charges.

I may not have been one of the people doing the bashing, but I will say this was about the most backward statement that I've ever read. Politically correct, Baltimore etc. Yep, everyone knows when you think of those things you think of East Tennessee. Your post makes it sound like people just started questioning the KPD about UT, when the media started focusing on their stories. I have heard these things around Knoxville since the seventies. I don't know if any of the accusations of these people are based in fact or not, but I do know that your statement was about as inaccurate as possible.
 
Title IX has no bearing on criminal proceedings. They are separate issues. I think most have an issue with there being no movement.

College students throwing parties on their own private property with, gasp - BEER - are a notorious menace to both public peace and the State and must be stamped out with impunity by the KPD. This is of the very highest priority, as you should know.

NO those cases are really not difficult at all to prosecute, in fact they are relatively easy to prosecute. Date rape cases are what are hard to prove.

No. A lot of the time, it is a 'he said, she said' case. Whether the parties involved are dating or not. There can be evidence that may imply something happened. Then it must be determined if what happened was consensual to the best ability possible.
 
So anyway I'd like to get this M&M thread back on track. I felt that topic generated some very meaningful dialogue. The blue pretzel M&M won today, and I have named him Steve. He will enter the finals tomorrow against the Green classic M&M. May the best chocolate candy win.

I've seen the M&M arena copy and pasted 1000 times, over the last few years. Please don't credit something you've read over the Internet to yourself.
 
Title IX is driving all this and nobody wants egg on their faces. DA clears him and then the Title IX board fines him guilty, then, where do we stand. I am beginning to believe we might not see him until next year or never again. This is what it has come to in the system. More hurdles to cross in these type situations for Student Athletes than non Student Athletes. More emphasis because of the spotlight.
