Nah. The degree to which the lawyer is on the hook or their reputation is at stake doesn’t change based on the existence of qualified immunity.

They’d still have to establish duty of care, breach, and damages, and that standard could be reassessed once QI is gone. There’s a lot of wiggle room being QI and any standard that would make frivolous cases worth pursuing. It would make sense for that standard to be pretty high for the same reasons we have QI.

Lawyers would still evaluate and price cases based on the likelihood of a payday, just like they do now, just like any other civil case.

That omission, by itself, gives me great pause at this stage. So far, it sure doesn’t look like a good shoot.

Anyone stupid enough to BRING a weapon (legal or otherwise) to a mob action confronting armed federal agents is pretty much guaranteed to be a candidate for a Darwin Award, About as smart as smoking in a fireworks factory.
