I would say much of the court's position revolves around the factual elements, not one of a clear inability of the U.S. to eject.The Bill of Rights covers all 'persons' in the United States, so yes someone here on a visa has a 1st amendment right to speak as they see fit without government retaliation.

Even Americans have limitations on free speech, meaning if an American is being paid than its commercial speech for instance. Which is why Hunter Biden was eventually going to be charged as an unlicensed Foreign Agent.
