I would say much of the court's position revolves around the factual elements, not one of a clear inability of the U.S. to eject.

It's not an apples to apples comparison. Have you read the details on that case? The problem was a lack of evidence:

In 1939, the United States Government initiated deportation proceedings against Bridges, alleging he was a communist. The attempt failed due to a lack of evidence that Bridges had ever held formal membership in the Communist Party. In 1940, the United States Congress passed the Smith Act, which — among other things — allowed the deportation of an alien on the basis of their affiliation with an organization advocating the overthrow of the United States Government.


There was nothing they could pin on this guy other than innuendo. I agree that's not enough to deport someone. In other words, he didn't say anything on the record that they could use as a reason for his deportation.

I would say whatever that insane Beard is implying i.e. everyone has the same Rights, as a generalization is legally retarded. Under that theory, anyone that gets into the country legally or illegally can't be deported or ejected because we have all the same Rights. 😂

Where in the Constitution does it say that our gov't can't revoke visas? If you act like an ass while visiting our country, we should have the right to say we don't want you here. We're not charging you with a crime or anything. We're just saying "you're not welcome here anymore"

Constitution only applies when their feelings arent being hurt and/or their guy is trampling over it. Id like to see Trump make flag burning mandatory after every pledge of allegiance. MAGA would die....or more than likely rationalize it like they do everything Trumples does and get in lock step with their orange king.

Laughing at someone's murder is supporting terrorism? Since when? Low class sure. But not "deportation " worthy. Remember that D grade actress who held a fake Trump severed head? Lots here screaming for her deportation or imprisonment. If bad taste and no class were a crime, Trump would be decades into serving a life sentence.

Only citizens should have rights protected by the constitution. But that ain't the world we live in.
 
As a generalization, the United States sets the conditions of foreigners entering the country. The U.S. can revoke all visas if it wishes.
The government can do a lot of stupid stuff if it wishes. Having good leadership means not doing a lot of stupid stuff. Playing tinpot dictator with things like visas is stupid stuff.
