Better than ever is quite subjective. For everyone except for the fans maybe, but I think the overwhelming majority of fans would strongly disagree that today is better.
I will say that watching SEC play last year w/ TEX and OK added, along w/ at least 10 teams who could beat most anyone on any given week (Ark vs UT) definitely added to awesome games to watch. Think it's a long game to sort all the portal/NIL stuff out, but they should definitely solve low hanging fruit stuff, like eliminating the Spring portal. Close winter portal 2-3 weeks after championship game and that's it...no spring portal...does too much damage to coaches trying to build their rosters. Then, move on to the next thing.

We're trying to compete with much bigger schools that have a bigger fan/alumni base and more wealthy alumni. We did a great job getting out in front initially but we just don't have the dollars to fund it like the top schools
There must be a "cap" established at some point

You're not all wrong here (one of best films ever btw). JH has the chance to do some of this stuff...he almost got there w/ Hooker, and could have gone deeper LY with better QB play. Stout D and rushing attack...if we get a QB who can get first downs (like Billy Bean/get on base), then we've got a shot.

With the lawsuits, which UT supported, I don't think you can legally keep an athlete from transferring when any other student can transfer nor can you impede their ability to earn NIL money by stopping them from playing if they do transfer when other students can transfer.

You can't legally stop a student from transferring just because they play sports nor prohibit their eligibility because they transferred. UT, via the State, supported that lawsuit.

Might be something that would be established with an exclusive P4 league. Even with the current setup, conference commissioners, with support from each university of those conferences, could probably get some sort of binding agreement
Legally, it's been shown, the NCAA nor anyone else can "cap" NIL deals. Period. Boosters can always hire a player and pay them to show up, sign merch, whatever.

They can cap the "House settlement" internal NIL for teams but the NFL nor NBA could cap the millions Jordan made nor Gronk made while playing.

They may try to say "the NIL value is inflated and you're just paying them to play" but what team wants to sue or let the SEC sue or let the NCAA sue their boosters????

Yes, I get that. They're being paid "endorsement" money under the current system. One thing they can do currently is require contractual agreements for appearances and advertisement in order to get paid

I believe they have those contracts (I don't know for sure) because Arky's collective is debating suing Nico's brother over breech of contract.

Wisconsin is suing or considering suing and refusing to send transcripts of, I think, a player or FSU or someone over an NIL contract and them transferring.

I don't know what the contracts are but we heard that Nico wasn't meeting his agreements which I assume are spelled out via NIL contracts or the collectives are running on faith, which for big money would be more insane than I can imagine.

NIL is all marketing and what the athletes value is in the local market. IMO Knoxville doesn’t have enough marketing avenues to support that type of investment in a team without the donors and fans pony up the funds to pay them. These bigger cities with large companies that can pay for a player to promote their business are always going to win out over a smaller market such as Knoxville.

If Arky's collective was stupid enough to pay ANY athlete an upfront NIL of 200k before they performed ANY service, they're stupid.

I recently paid someone for a service that was ongoing. We had an escrow account that I made a deposit to, then they made various itemized "draws" as demonstrable services were provided. Upon the account being drawn down to a certain level, I made other deposits. At the agreed end of services, they cut a check to me for the remaining escrow. This is pretty standard for contractors, retained attorneys, and retained accountants, at least I have always done it this way.

If Arky doesn't have enough business sense to protect themselves ..... well, they ARE Arkansas, I guess.

If it’s going to work long term, there’ll need to be salary caps or luxury taxes to somewhat level the financial playing field. And that presupposes that direct pay hurries up and becomes a thing. Any SEC/B1G team is better positioned than anyone who’s not an SEC/B1G team. But generally, if you’re signing $50M student rosters and no one else is going to approach half that, it won’t take long for the interest to dry up and for it to be obvious that not everyone’s playing the same game. The folks who want this to continue to be a multibillion dollar TV enterprise won’t let it come to that.
Since we already had salary caps of zero and schools like Alabama were paying under the table and getting away with it….How are you going to police the Alabama(s) of the world in your NEW salary cap world?
