If I’m negotiating a collectively bargained contract as a union rep, I’m expressly excluding non-striking employees from any contractual benefits. If the employer chooses to pay the non-union employees the same or more, then that is their prerogative. What does it say about the company if they do give it benefits to non-striking employees? To my understanding, companies don't have to do that. They should be able to pay whatever they want.
