Von Pearson Update

Maybe I missed your point Face...No one at the school, no one in the DA's office could be blamed for turning a blind eye to Pearson's saga.

In Winston's case, there is alleged police misconduct, alleged interference by the school into the legal investigation and above all else the Coach stepped out big time for his star player.

Nothing remotely like that is occurring here, maybe that's because he isn't Dobbs, but no one in the National or local media is asking how did Pearson get off easy. They are going the other way if anything.

This is ridiculous.

To my knowledge, the only thing that would bar criminal charges being brought in the future would be double jeopardy attaching, or the SOL running.

Depending upon which sexual crime could be charged, there are statutes of limitations that might be as much as 15 years, or so. Double jeopardy would, at a minimum, require a jury being sworn. Neither of those has been satisfied in this case, so I would imagine the DA is free to reopen the investigation, or to submit the case to the grand jury at any time.

So it's not in VP's best interest to grand stand. He would want it to be resolved as quietly as possible. It's possible that in a UT hearing he could say something that could be used against him.

As in, look for news today encouraging. By late Thursday, multiple sources on campus --- both sides of the aisle, academics and athletics --- indicated Pearson would be reinstated to school imminently, and when Pearson is reinstated to the school he will be welcomed back to the football team.

His academic standing is strong, despite the absence of summer classes, because Pearson had a very strong showing in the classroom during spring semester.

While we have confirmed that the University will not comment on Pearson's reinstatement from an academics standpoint, Butch Jones is expected to make a statement on Pearson's return. However, legal sources indicate it's likely no one will be able to speak very much whatsoever on the matter.

While Pearson has not been around team activities, he has remained in Knoxville. His physical condition isn't fully known, but Pearson has been spotted on a half-dozen or more instances playing basketball on campus in the TREC.

Pearson and his attorney did meet with UT academics/admissions officials on Wednesday, after it was announced Pearson would not face charges stemming from an April 24 sexual assault allegation. A reinstatement could simply mean he's back and all of this is over or Pearson could be reinstated and still have to go through student conduct. In on campus student disciplinary matters, a student has the right to chose to go before the student conduct board which is what is sounds like a board of your peers that would make a ruling. That's the fastest method or you could have an administrative hearing where it's heard by a judge and the student has legal representation present. Pearson had to pick which one he wanted to have last week and because at the time the district attorney's office had not made a ruling Pearson chose an administrative hearing. We will see if that ever comes about.

With improved leadership evident in a variety of areas inside the football program, don't be too surprised if Pearson's expected to both address his teammates and have his teammates address him here with his return.

Yeah I think you misunderstood me. I was going off Ericvols post about how, since the school seems to be concerned about reinstating Von in the current rape/domestic violence hot button topic environment, that it bodes well for the school to wait it out so that the public is more on Vons side.
 
Yeah you're right. Von was completely framed and totally innocent of ANY wrong doing here, legal or illegal. He was pure as the driven snow and wasn't a contributor whatsoever of any kind of incident that prompted this woman to report him.

Look, I'll support whatever the university decides. If they say he deserves a second chance then great! Enroll him and stick him out on the football field. If they say he behaved in a manner that is irreprehensible and needs to go, I'll support that too. I'm just tired of seeing all the "poor poor Von" posts when no one has a clue as to what really happened. Everyone is so damn ready to see him on the field, it's like they don't even stop to consider what he may have actually done and just because it wasn't found to be criminal doesn't mean it wasn't worthy of suspension.

You're correct. I do want to see Von back on the field. This chick has already proven to be a liar so why should we believe anything else she has said? Proof is in the pudding.

I'm not suggesting that you believe anything she said. I'm simply saying we shouldn't be so quick to declare Von in the clear just because he was found innocent of any criminal actitivy. Just trust the process and be patient. We'll know something one way or the other soon enough. It SOUNDS like Von's going to be OK. However let's just wait until everything is confirmed.

We know what he did not do and that happens to be what was alleged. Again, "we are gathering facts"...he's still a member of the football team, he's on the roster you can check...you can also "check" to see if Michael Williams is still in school...and BTW type in Lavon Pearson and you get a blank screen.

What else is there?

It seems like some can't believe the truth, that the University can make mistakes. They have.

No we don't... But it's looking like he may be cleared of any wrong doing. All we know right now and last night is that there are no criminal charges. This has been said many times. I don't know why it's hard to understand. We know he's not guilty criminally, that's all right now. We still have to follow TitleIX, that's federal law by the way, not UT rules.

It's so simple and that all we are saying, lol... It's not our opinion, it's the facts. People keep thinking me we are saying we know what he did when it's actually them that act like they know what happened just because he's not criminally charged. We are past that, that's not the point, it has nothing to do with criminal charges now. Is he guilty of anything civil? Or that would violate Title IX? Or something to cause her to feel unsafe? You don't know, and I'm not saying presume guilt or that it's even fair. What we have to do is wait and see just like you had to with the criminal side of the investigation. We aren't saying what he did or didn't do outside of criminal behavior... We are saying we don't know yet so let's see what they say. It's looking good today however.

I just looked at the roster and Von is listed.....has he been reinstated or never taken off....apologies if i missed it earlier in one of the other 200 pages!!!

If they're smart they'll do it as low key as possible. Quick statement by Butch on the course of his usual after practice remarks then move on.

Was never taken off.

But, expect him to be reinstated today and at practice tomorrow, if not tonight

Oh good lord, I don't know if he did anything wrong or not.

Then STFU. No one knows what happened. Stop trying to be that guy that takes on the white knight role and defend the girl. There is no evidence to support rape, the lack of evidence supports the girl overreacted. Was Von charged with making a mistake or being in the wrong place at the wrong time? Nope it appears he was charged with rape and cleared but you want to be the guy to still piss on his reputation and say he was in the wrong.
