With this mentality an Alabama fan could call the cops and accuse Dobbs or any player of the same thing, if they didn't have a solid alibi, we would automatically lose them to suspension.

This whole notion of ruining peoples lives just because they are accused of wrongdoing is despicable...I have had a really close friend who was really sexually assaulted, and close friends who made false accusations. For the made up ones..it is always the same..Hell hath no fury like a woman scorned..they are the ones who run and blab. The woman who was raped..only told me and my wife. The fool who did it was a drunk pissed off ex. He broke into her house in the middle of the night and set up a camera. He was so drunk that after he forced her, he freaked out because she just kept screaming and ran out, leaving the tape. She only told us. She showed us the tape, and asked us to keep a copy in case anything ever happened to her. She was so humiliated and embarrased that she didn't want anyone else to know. That is my experience.

Go after the running backs. UGA = Chubb .. Bama = Henry ... Arky = Williams & Collins (fabricate some kinda twofer deal to get both those guys) ... Florida = Taylor ... Mizzou = Hansbrough ... and Oklahoma = Perine.

If (IF mind you) the police declare him innocent/never bring charges, why does the school need to investigate?

First, schools need to stay out of these matters. They are criminal investigations and those in higher learning have NO place doing the duty of an officer of the law, especially given the propensity in the past with which schools have destroyed the lives of the accused without evidence.

Second, what could she sue him for? If the police declare him innocent, he should sue her for slander if anything.


UT is required under Federal Law to investigate the matter separate and apart from whatever KPD does. Title IX requires UT to investigate any complaint concerning harassment or sexual conduct that comes to its attention. It is really a very complicated requirement and most schools tend to err on the side of the accuser.

Without going into lots of details there are a few things that come to mind that she could sue him for, starting with something as simple battery, and going up.

I won't pretend to know anything about law enforcement or attorneys. My knowledge is limited to what I see on tv/movies/print. But my logical question is this....it has been over 4 weeks now and if you haven't at least interviewed or questioned people that you believe are relevant....aren't the chances greater that they may have forgotten some details or facts that could have been important?

I won't pretend to know anything about law enforcement or attorneys. My knowledge is limited to what I see on tv/movies/print. But my logical question is this....it has been over 4 weeks now and if you haven't at least interviewed or questioned people that you believe are relevant....aren't the chances greater that they may have forgotten some details or facts that could have been important?

Answer may reside in that question. I suspect that every relevant person has been questioned. This is a cooling off period. The appearance of a long investigation will assuage the ire of the advocates on the other side of the outcome. Law enforcement hates to hear "That was awfully quick".

Wouldn't it have been a whole lot easier if he had just kept his junk in is pants? Jeez. What's so hard aout that? It keeps these nasty accusations about assualt and possible rape at bay. Why is this so hard? Don't most 5 or 6 year olds learn that I get up in the morning, I shower, I put on my clothes, I go to school. I come home and play and the whole time I keep my organs put away in my pants. No problems. Did Von not learn this?

Civil court is all about money. And you still need evidence. If she doesn't have evidence, and Von doesn't have money, this is unlikely to go very far legally.

Well, first, police never declare anyone innocent (or guilty). They don't have that authority. It's not their job. Their role is simply to gather evidence for use in court so that a judge or jury can decide innocence vs guilt...if the prosecuting attorney determines the police have found enough evidence to be going on with, and can then convince a grand jury of the same.

Second, universities and other institutions are free to have honor codes and other codes of conduct above and beyond what's covered by US and state criminal law. And are free to investigate possible violations of their code. There's nothing at all unusual about that.

And third, anyone can sue anyone in civil court for just about any real or perceived tort. Doesn't even have to be monetary in nature, though monetary penalties are often how the cases are resolved. So VP's accuser could certainly take him to civil court for any of a number of reasons.

2. Honor codes should apply to things that apply to school, like academics. I find it highly inappropriate to entrust my future, or the future of anyone around me for that matter, to teachers on anything other than the subject matter they teach. If police, with forensic evidence and professional investigation cannot prove there is enough evidence to bring formal charges, why should a school? The evidence required to kick someone out of a school is much lower than to charge/incarcerate someone, which can easily lead to the school simply picking a side baselessly in a he said she said case as to not look soft on sex crime allegations.

3. Yes they can, and I disagree with that. People abuse our legal system daily for monetary gain and it's a mockery. That being said, I would hope if Von is innocent he would countersue.

He's certainly right to the extent his point is that it is nearly impossible to convict someone of rape if the only evidence the prosecution can put on is testimony from a single accuser, countered by similarly credible testimony from the accused. I have no problem with him saying that. (And incidentally, that is how it SHOULD be.)

But he went off the rails when he:

(1) suggested that, the evidence (or lack thereof) in his case notwithstanding, Von is a rapist and shouldn't "go free" because... well, because, kyoon (in his omniscience) knows that rape accusations are "usually" well-founded, and rape victims "usually never recover";

(2) said it was impossible to prove that a rape has occurred;

(3) said I "obviously" know nothing about the criminal system (without knowing any of my professional and/or personal background, mind you); and

(4) started trying to bolster his credibility by bragging about going to a top-20 law school.

The first two are troubling and incorrect, respectively; the latter two are just LOL-worthy--so that's what I gave him.

Fair enough. I really only meant he was right about allowing propensity evidence in sexual assault cases. I don't back up or support his personal views.
