That’s actually where they should go since they paid the tariffs. Gonna be interesting to see if he try’s a half assed end around and cuts checks to people. And if importers will file a class action suit in response
Saw an interview just now with the small importer who brought the original suit. He said he expects the administration to obfuscate and delay (stunning I know). He did say that no matter what the government says, it would be fairly easy to refund the tariffs to businesses that were impacted. Said the tariff (tax) was electronically withdrawn from them and they should be able to identify it and refund it easily. He shouldn’t hold his breath. I’ll bet Trump doesn’t make it that easy or quick.

Expect a vengeance and retribution campaign against the business that brought the lawsuit. Pedo Pam will get 'em.

Not holding my breath. My company paid about $35k duty on one particular imported batch of catalyst. mid-2025 because our broker screwed up and forgot to slip it into their FTZ as we had it earmarked for a project in Canada. I immediately wrote that money off mentally but my son, bless his heart, went through the exercise of filing a duty drawback claim when we shipped that batch to Canada in August. What do we get from CBP? Crickets besides some BS that our inventory accounting does not meet their standards. Not to mention about $100k in tariffs on a couple other batches coming in from the EU which we are mostly supplying to US customers. I do not expect to ever see a penny of it back. Now that’s not to say I do not support the re-shoring of strategic manufacturing. I just hate having to deal with the greedy, bloated, wasteful bureaucracy our federal government has become.

Yeah that’s part of it but you obviously didn’t read the Faces tab. This isn’t some small family business. It’s a small business owned by multiple different millionaires.

Highly unlikely anyone is running anything up to the SCOTUS without major political or financial backing of some special interest group or another

Probably not. But at the end of the day, I don’t care who’s backing them. $2 million in sales and 12 employees is not big business to me.

There is also another small toy manufacturer in Chicago who sued and won as well. Again a small family owned business, not a DuPont. The point is that these weren’t major corporations that won. (Might be some of those also that sued. Haven’t paid that close attention.)
