There is no equivalency here with prior administrations, again, at least in my lifetime, democrat or republican.

Agree up until the last paragraph. I think this one is all video evidence and I don’t officer mindset will apply. It hinges on the still of the victim’s weapon in the ICE agent’s hand if that is deemed to have occurred before the first shot rang out it’s a bad shoot. And I see no way any ICE agent can make a convincing argument they thought they were imminent danger.

If I have my firearm in my hand trying to subdue an armed suspect (yes we know he had one gun taken but officers are trained to assume there are more weapons on their person) who is fighting me, and he grabs that firearm, it easily could go off accidentally OR i can legally keep him from grabbing my firearm by using it purposefully

Now you want to argue the tactical merits of trying to wrestle to handcuff a guy with a firearm in your hand, go for it. I sure wouldn't do it, but it's not illegal in that first scenario.

If the suspect directly caused the firearm to go off by grabbing it purposefully or accidentally it 100% is a good shoot. This will be proven with the ballistic evidence.

If the officer kneeling was the one and he accidentally squeezed a round off while fighting the guy, it's likely not a good shoot, although a little more of a grey area (think you might or might not be covered by law, but you are paying off his family civilly by a lot and getting fired and 50/50 on grand jury stuff)

If the officer standing was the one who fired the first shot by mistake, he's done....100% illegal and he should be fired and prosecuted
