We were coming back on post one night in my buddies TA through a back gate drunk as a skunk. He ran it into the woods so we humped back to the barracks. Next morning MPS showed up and tried to give him a DUI, didn't stick.

I got into a bit of trouble for something similar a few years ago. We had a hit and run accident that I suspected to be a DUI when it happened since it was in the parking lot of the club on a Friday night. However, the perp turned himself in after 36 hours so there was no way to prove it. I gave him a ticket for the failure to report an accident and hit and run which got his license for 9 months. Leadership wanted to know why I didn't push for a DUI and couldn't wrap their head around the fact you have to be in control of the vehicle and intoxicated.

Idiots pulled the tickets and pushed for DUI instead. Lawyer got it thrown after about 30 seconds of laughing and the perp was driving the next day.

I feel like I don't have all the facts. How far was she? Why not just smoke outside the van propped up on it with the air running for the kids?

The Washington state crime lab made positive confirmation of the suspect through forensic evidence. Earlier in the week, the sheriff's office had collected DNA cheek swabs from dozens of nearby residents.

Well in Illinois there is a law about unattended vehicles left running --- even in the winter when people let a car warm up before leaving for work or whatever -- Grandvol -- care to comment on this story ? Good job or bad job by the police ?

I think several of the facts aren't known right now to make a qualified judgment. The terms they used about "being in the area" are pretty vague. That could be two cars over, that could be two blocks down the street. Specifically how far away was she and could she effectively monitor the vehicle?

I will say that the air conditioning, no matter if it was on or off, doesn't run effectively when a car is sitting at idle. So no matter what, that vehicle was probably starting to heat up. And another fact I'm curious about is whether the doors were locked (did she have a key fob?) And whether or not she has prior history or not. That could be a large contributing factor here that's not been stated.

The case in Atlanta with the kid that died in the car is probably at the forefront of a lot of people's thinking, cop and citizen alike. So in a case like this, I'd almost expect it to go down the way it did. She'll have her day in court to prove her innocence. Or the DA can toss it out without it ever seeing court. Hard to tell at this point in time since the articles really aren't that forthcoming with everything that happened.
