He's not going to get to stay in this country as an illegal with a deportation order for the rest of his natural days. I know that angers you, but that's the way it is.

Heh. Such a definitive statement for such a unique case... I'd say it's probable that Garcia is ultimately deported, but maybe not...

For instance if the United States follows through on its threat and deports him to Uganda, but then Uganda deports him to El Salvador, the DHS would consequently be in violation of standing court order preventing Garcia's deportation to El Salvador. This would create a giant cluster F. At any rate, prior to such deportation, Garcia could seek Withholding of Removal to Uganda - delaying or preventing his removal to that country.

Similarly, Cancellation of Removal is a possible legal route to both delay and possibly prevent - permanently - Garcia's deportation.

As long as the US is not involved than it would not be a violation of the order, technically he could fly to El Salvador or anywhere else he wanted. The US could hit him with a Hellfire missile for instance.

Nothing really unique about it other than a bunch of nuts.
 
One would think... but a lot of normal judges don't like Trump's ongoing efforts to usurp their power. It would not surprise me to see the judge in this case throw out all charges and issues an injunction on his deportation.

The judge has no ability to throw out the deportation order, he is an illegal. His attorney is playing games and the court is playing games, and that is about as much as what is going on. Nothing would surprise me but its just a bunch of nonsense.

What we need, is rather than spending billions supporting illegal immigrants, we need to spend that money vetting and quickly assessing and spproving the paperwork for legitimate immigrants.
And permit a process for companies to vouch for their employees.
 
In a video posted by the Department of Homeland Security on Monday, Kilmar Abrego Garcia can be heard saying the words "gobierno corrupto," which is Spanish for "corrupt government."

In the footage, the Salvadoran man is seen bound by restraints while being escorted by an individual wearing a vest that reads, "POLICE ICE."

The DHS post on X containing the video declares, "He doesn’t belong here. He won’t be staying here. America is a safer nation without this MS-13 Gangbanger in it. Good riddance."


"On Monday, U.S. Immigration and Customs Enforcement (ICE) officers arrested Abrego Garcia in Maryland at an ICE processing center on federal immigration violations," a DHS press release declared, noting, "Abrego Garcia is being processed for removal from the U.S. to Uganda."

"Kilmar Abrego Garcia is not and will never be a Maryland Man – he is a criminal illegal alien from El Salvador and public safety threat," a senior DHS official said, according to the release.

 

Kilmar Abrego Garcia can’t be deported until at least early October, judge rules​


A federal judge is planning to have Trump administration officials testify in early October about the government’s efforts to re-deport Kilmar Abrego Garcia and is prohibiting his removal from the US for several more weeks.

US District Judge Paula Xinis on Wednesday set an evidentiary hearing for October 6. Xinis said she would rule within 30 days of the hearing and that Abrego Garcia must remain in the US until then.

Abrego Garcia is expected to remain in Immigration and Customs Enforcement custody.

In the meantime, his efforts to stave off another deportation will happen in other forums.

First, he will have an interview with immigration officials who will assess whether he’s credibly made a claim that he fears being persecuted or tortured in Uganda, the country the Trump administration is planning to send him to. If they determine he has, they must work to identify another country to deport him to.

Justice Department attorney Drew Ensign said that he expects that process to take at least two weeks.

Abrego Garcia is also separately seeking to renew his bid for asylum, a process that will play out before an immigration judge within the Justice Department.

Kilmar Armando Abrego Garcia[a] is a citizen of El Salvador who was illegally deported from the United States on March 15, 2025, in what the Trump administration called "an administrative error." He was subsequently imprisoned without trial in the Terrorism Confinement Center (CECOT), a maximum-security prison in El Salvador, despite never having been charged with or convicted of a crime in either country. His lawyers argue that his imprisonment is part of an agreement to detain U.S. deportees there in exchange for payment, a claim that was confirmed by U.S. senator Chris Van Hollen, who had spoken with Félix Ulloa, El Salvador's vice president. The administration has defended the deportation in the press by accusing him of membership in the MS-13 gang, a U.S.-designated terrorist organization—an accusation based on a bail determination made during a 2019 immigration court proceeding, which Abrego Garcia contested.

Abrego Garcia grew up in El Salvador and then immigrated illegally to the United States in 2011 at the age of 16 to escape gang threats. In 2019, an immigration judge granted him "withholding of removal" status—a rare alternative to asylum—due to the danger he faced from gang violence if returned to El Salvador. This status allowed him to live and work legally in the United States. At the time of his deportation in 2025, he was living in Maryland with his wife and children, all American citizens, and was complying with annual check-ins with U.S. Immigration and Customs Enforcement (ICE).

On April 10, 2025, the U.S. Supreme Court unanimously ruled that Abrego Garcia's removal to El Salvador was illegal. The Court rejected the administration's defense, which claimed it lacked the legal authority to exercise jurisdiction over El Salvador and secure his return. Justice Sotomayor noted that this argument implied the government "could deport and incarcerate any person, including U.S. citizens, without legal consequence, so long as it does so before a court can intervene."

The Supreme Court required the U.S. to "facilitate" Abrego Garcia's release but stopped short of a lower court's directive to both "facilitate and effectuate" his return. The administration interpreted "facilitate" to mean it is not obligated to arrange his return and can meet its obligation by admitting him into the U.S. and providing a plane if El Salvador chooses to release him. President Nayib Bukele of El Salvador has refused to do so, stating that he would not "smuggle a terrorist into the United States".
