No, he doesn't have them confused at all. Michael Smith is a co-host for "His and Hers" that airs at noon on ESPN 2 and he went as far to say that IF what Butch said was true he should be prosecuted. Ok...IF he said it, I agree he should be let go...but PROSECUTED? Come on man!
When ranting about ESPN lack of journalism you have to remember they are not really journalist and really just commentators. They regurgitate sports information that is passed down to them. They don't investigate stories or dig up any information especially regarding the law.

I think most are confused by the lawsuit itself. They aren't trying to find the players guilty of rape. They are saying the way UT handles the cases isn't fair to the alleged victims. They are accusing Tn of playing Law and Order. IF the accusations are true that they do not go through the police and instead hold their own hearing with offering the defendants counsel and the alleged victims not the same is concerning. We are talking an University setting, Not the court system. No prosecutors are present so the alleged victims are left to fend for themselves IF true. To add injury to this, the University appoints the hearing officer (judge) so it can be easily viewed right or wrong that they will protect the interest of the school.
Again, IF this is true, it does need to change. That is what the lawsuit HAS asked for. I do not know these girls personally nor the accused. Nor do you, don't judge either way, let it play out. Amazes me people take sides without any knowledge whatsoever, just going off ignorance. The worst part, an attorney said yesterday if this plays out till the end, it will take two years to completely resolve. For the big picture, a settlement looks likely. Second part to worry, has the Feds left campus investigating the Title IX with their findings? They are kind of like a house inspector, they will make sure they find something.
