Maybe we disagree on the definition of "dirty" in this context. Given that Holcombe did not intentionally hurt Kamara, nor did he hit him in such a way as to indicate disregard, it's not dirty. If all penalties are inevitably "dirty" in your way of thinking, then okay. We are operating with different contexts.
I'm not sure it's possible to rob a bank without realizing you're robbing a bank.
