Jeremy Banks needs to be dismissed

I agree that theres different levels to the idea.

1. "eh, nothing to it at all, everybody should just forget about it, he's just a kid, Play Ball!"
2. "It was stupid and reckless and Pruitt should make sure he knows as much, but I don't think he should be suspended or dismissed"
3. "It was a terrible set of comments and actions. He should be immediately dismissed from the team and Id be fine with him being criminally charged with the threat."

#1 is the only one that pretty much removes any sense of it not being the right thing to do.
#2 Acknowledges the action as stupid, but also allows for a level of defense from the standpoint of allowing him a second chance.
#3 is the only idea that totally takes away any sense of someone defending or diminishing it on any level.

There may be a couple more but most everyone with an opinion falls under 1 of those groups.

Im not going to speculate on what that makes them as a person.

I vote for #1. Let's have a poll.

In Tennessee, a threat can be prosecuted as assault if one "intentionally or knowingly causes another to reasonably fear imminent bodily injury". T.C.A. 39-13-101(a)(2)

There's no reasonable fear of imminent bodily injury from someone handcuffed in the back of a police car, so the cops couldn't have charged him for what he said even if he'd been more explicit instead of just insinuating.

That said, it's a bad look for Banks and the Vols, and I hope he will exercise better judgement going forward. I also hope we're not seeing the start of a pattern from Pruitt's recruits. You shouldn't have to do legal research to discuss Vols football.

I’m certainly all for another topic. We’ve rung this ones neck and everybody is still in their respective camps.

Careful what you ask for though. Hopefully the next topic will be nothing more than a reaction to the Georgia game.

I didn't say it wasn't a threat. My post was about whether it rose to the level of an actionable offense under Tennessee law. What part of my post "couldn't be any more false"?

No a police officer cannot charge someone for stuff like that.
 
Threatening a female seems very thug like to me

This is all over Banks making a mistake. Then Banks not taking care of the mistake. Then those problems multiplying. Then Banks knew about the problems (suspended license & warrant) but chose to drive anyway, and even chose to make an illegal U turn.

Banks never made a direct threat to anyone (as there are “fighting words doctrine” and he didn’t cross the line).

however what he said was bad.......and the entire situation made Tennessee and the football program look even worse (not what Tennessee needs right now).

No need for anyone to “down play” the situation, or even try and make “more” of what happened (maybe not you, but people have been)......it is what it is....not a murder threat, but it was a bad situation, start to finish.

It will be predictable. UT will more likely lose big as most here have predicted throughout the last 2 weeks. The comical part will the uproar over it knowing that.

I was starting with the belief that Banks's statements were threats despite how vague they were. Then, I looked for Tennessee laws involving threats, and that's the law that covers this situation (as best as I can tell, not being a lawyer).

Here’s what you appear to be quoting. That is regarding assault, not threats.

It did not “start” from a U turn. That night, that situation “started” because Banks chose to drive even though “he” knew his license was suspended and he had a warrant........which was “caused” by mistakes he made even earlier and never chose to correct.

There is only one faction that will be surprised if that happens. And many of them will have the worst initial reaction. At least they’ll have the players to blame.
 
We've seen this over and over. I feel bad for these kids that have these issues. But we know, it's only a handful at that, when you hear these stories from their college days, they go on to be wonderful successful people. More often than not, they don't. True change is hard and normally only happens when hard times hit. When you refuse to change and it causes such chaos in your life you have nothing left to do but change. Few get that. I'm gonna hold off on predicting Mr. Banks future. I hope he finds happiness and success. But I don't have a lot of confidence.

Most have UT getting blasted this weekend some of that group have them going 1-11 or 2-12. Ga St and all.
Pruitt will somehow be worse than today after the shot was called correctly.
