Well if you know about implied consent why did you say he could refuse when he still would be arrested? You clearly aren’t versed in law because you didn’t understand why they didn’t let him “walk to his sisters house”
And “harassment”? Jesus he was passed out in the middle of a drive thru behind the wheel of a running car? I guess the police should have told the callers to 911 “no biggie we might harass someone by talking to them”?. They did nothing that was discrimination or harassment
Because there is still discretion the officers can practice. Jesus. He actually said look, I can walk over to my sisters house that is close, the officers could have just said have her come pick you up, anything. Bottom line, him refusing to take a breathalyzer or answer questions is exactly what any good lawyer will tell you to do. Get arrested, if the officer really wants to do that, go to jail, call a lawyer, and then they get it thrown out at trial for lack of evidence.
He was not harming anybody. What does it matter if the car is running? He shouldn’t have resisted. Got it. Im not even arguing that.
