Well if you know about implied consent why did you say he could refuse when he still would be arrested? You clearly aren’t versed in law because you didn’t understand why they didn’t let him “walk to his sisters house”🙄

And “harassment”? Jesus he was passed out in the middle of a drive thru behind the wheel of a running car? I guess the police should have told the callers to 911 “no biggie we might harass someone by talking to them”? 😂. They did nothing that was discrimination or harassment

Because there is still discretion the officers can practice. Jesus. He actually said look, I can walk over to my sisters house that is close, the officers could have just said have her come pick you up, anything. Bottom line, him refusing to take a breathalyzer or answer questions is exactly what any good lawyer will tell you to do. Get arrested, if the officer really wants to do that, go to jail, call a lawyer, and then they get it thrown out at trial for lack of evidence.

He was not harming anybody. What does it matter if the car is running? He shouldn’t have resisted. Got it. Im not even arguing that.
 
Yes he could’ve easily used the taser to carjack someone or break into someone’s house to hide from police. A clear threat to others. Tennessee vs Garner. All day long. Easy case

Shooting somebody should be for a clear and immediate threat. Not a “could’ve” situation where somebody is running away. If that is the way the law is written then it should be changed.

Argue it before the Supreme Court then. But he proved he was a clear and immediate threat. Hell he was shooting an officer with the weapon when he was shot

Rayshard should have walked over to his sister's house before getting behind the wheel and passing out. I recognize that the officers could have allowed him to walk it off, but it's a crime to be drunk behind the wheel and a perpetrator shouldn't expect to just walk away because they've now determined themselves to be in big trouble.
 
It’s a valid question why at that point the police wouldn’t just let him walk to his sisters house. I’m not an expert and I don’t know what the officer’s thinking is. But why not just diffuse the situation, let the guy walk home, and go about your shift?
They never do. Had a very similar situation while in college and ended up named in the crime log.
 
The guy was standing directly in front of her behind a door shooting at police. Police can’t magically shoot at the suspect firing on them and keep evert bullet from going around him or thru him. This isn’t the Matrix

There are probably a lot of people in the second amendment threads who have firearms in close proximity to where they sleep and say they would come out shooting if somebody broke into their house in the middle of the night.

I think Ricky's right on this one in that it's a liability issue. If they let you go knowing you're impaired, and something happens, they have culpability.

Why would you fight or try to flee from the cops ? Again I don’t understand this mentality.
Neither do I, but I also don't think death is a reasonable result. Problems exist on both sides and need to be addressed.

He shouldn’t have resisted. I will not argue that point. And on a certain level I understand the officers actions. I just don’t think it needed to get to that point, and once he was running away, taser or not, they didn’t have to use deadly force.

Personally, I would have asked the officers if I could call someone to pick me me up, and if they insisted on questioning and breathalyzers then I would have told them to politely go F themselves, went to jail, then had the charges thrown out.

Me- I can't drive and left my car at oci for that reason. I'm almost home (half mile maybe)

Screw the city of Seattle and it's Democratic socialist anti-american city council. Bow down to the idiot's demands. BLM demands have nothing to do w/black people living better lives. The goal of the Democratic Party is to keep the black people voting as a block for their power to stay in charge over them. The Democrats stay in control over their poverty & the lies of a better life .... that hasn't ever happened or will it come true for blacks.

I don’t know and I don’t understand it either.

When I was young , I was more afraid of my dad than any of our local cops . I knew the first thing they would do would be to call him . My fear of catching a good beating kept me out of a lot of trouble when I was young . The adult me figured out that fighting or running from cops would always end up worse for me than them , so I just never understood this concept .🤷‍♂️
