I don't see how one can say that Hart gets a pass if he is not fired for his decision to hire Tyndall. It is now part of his record.
For me, the athletic program is the sum of Hart's handling of the UT administration in support of sports, his handling of finances, keeping sports infrastructure at state of the art levels, making sure Tennessee's athletes are scholar athletes, being the guardian of UT's reputation nationwide, in addition to his hiring and firing of coaches for all sports. Relative to his performance of the job, I expect him to have integrity, personal accountability and represent UT very well.
Each person can assess each aspect of his performance and come up with his/her own conclusion about whether or not the sum total of Hart's "body of work" (Butchism) is worth or unworthy of retention.
Another aspect of Hart's not getting a pass for hiring and having to fire Tyndall is VolNation. I'm sure he will hear about it as long as he is athletic director at UT and until his death. Nothing ever dies with VolNation.
