You may well be correct on "due process" however a school or employer cannot violate someone's civil rights without exposing themselves to litigation.

I'm no lawyer, but if an employee is fired from a job for stealing and can prove they didn't steal then do they not have some solid ground for litigation? If I'm a student (especially a paying student) and I'm falsely convicted by a judicial councel for cheating and am able to prove otherwise then I'm going to employee the sevices of an attorney for a refund of tuition along with damages. Might be a waste of time but it strikes me as justice.

Would be interested in what the attorneys on the board would say.

Unless you have a contract or live in a for cause state (if any of those exists anymore), you can be fired for any reason as long as it is not on the basis of race, gender, etc. In other words, you can be fired for even the allegation of theft...nothing has to be proven.

Unfortunately, no - he has made a mess of it and hurt our team whether he did it or not. I am making no judgement on his actions, since I dont know what he actually did - but he clearly did do something that put him in a place to be easily accused of serious allegations. Its a hard lesson to learn at any age but especially young - giving the opportunity for the mere appearance of impropriety can destroy a career. Hopefully, he did nothing that cannot be remedied and is able to pick up his career a wiser man.

He made a mess of it or she made a mess of it? I believe the place he was in to be easily accused was a star linebacker slotted to go pro. After a hard 4 years of work and a win, he had a party at his apartment. No night clubs, no dui possibility and hooked up with a girl that he has known for a while.

If he did that forcibly, he should get thrown into an alabama prison with big bubba as a cell mate. Otherwise, he was just living his life. You think Dobbs doesn't go to parties? Or Worley?

Agreed. At this point, the best case scenario is A.J. messed around with a teammate's girlfriend in the middle of the night in an apartment with drug paraphernalia. I don't necessarily think any of that should amount to a crime, but it was gratuitously risky behavior from a team captain with millions of dollars in future earning on the line. Even assuming the best, this is a sad, sad story.

This one has been beat to death. That term just applies to court of law with the judge and jury. Court of public opinion is very differant.:cray:

For what it's worth (whole different level than AJ here) I was arrested for public intox as a freshman here at UT and my punishment from the school's judicial board was worse than my punishment from knox county.

Wrong. UT is a public institution (so when you say 'applies to government', that includes public universities, as well as k-12 public schools) and as such is legally bound to respect the constitutional rights of students.

Not sure how it can go to a grand jury when the KPD said on Monday that the investigation was ongoing and would likely take most the week to complete.

absolutely! I couldn't agree more. There is nothing worse than a police department that is very thorough and makes sure they cover every base possible. What a pathetic excuse for "the law." The shame I tell ya.

Title 8 provides the ability for anyone to fall under the guidelines of rape and in most cases almost impossible to prove. Title 8 claims that a female does not have to resist or say no to classify as rape. Basically they can decide days later that they shouldn't have done it... smh

So before having relations with your wife or girlfriend make sure you both fill out the 8 page consent forms and mail them to d.c. Then wait the needed 6-8 weeks for processing.
