I understand the process here...but did the exact same thing not happen with Jameis Winston at FSU last year? The guy was never suspended (coaches call I guess) but even then, from start to finish, did it take this long to come to a decision whether to charge him or not?

All felony cases in the State of Tennessee must go through Grand Jury to determine if there is probable cause to pursue the charges through Criminal Court. Some misdemeanors will go through Grand Jury if the defendant is requesting a jury trial or appealing a General Sessions Court trial.

The police have two options, make an arrest or present it to the Grand Jury. Most sexual assault cases are presented to the Grand Jury to keep the victims from having to testify in Sessions Court at a probable cause / preliminary hearing and then again at the Criminal Court level.

The time frame in this case, while it does not seem like it to some has been extremely fast considering there was DNA evidence to be processed by TBI. Considering it takes approximately 6 to 8 months to get those results back a month is very fast.

Every grinder ever has residue or kief in it, unless you just bought it. It's definitely paraphernalia.

But it doesn't matter. The cops weren't there for the grinder. They basically just confiscated it.

Even if he is cleared he still might not be back. Heard if he is cleared he might have to go to a meeting with the university and some sort of student judicial council or something like that and since the semester is almost over they will wait until the start of next semester after our bowl game. Could be wrong but that's what I have heard.

Don't think he will be back, but hopeful. The meeting with the university is hopefully just a matter of verification and nothing more. If he is not charged by the Grand Jury then the university should just rubber stamp it, but they may not which would be an injustice to him.

Second part of this equation is if he has been suspended or removed from the team. Seems like it has been in print that he is no longer with the team and it was a permanent decision, but who knows.

Seem to remember from earlier posting that the administration's investigation does not parallel the criminal investigation. Since AJ is under some type of suspension, does not mean lack of criminal prosecution negates any further action from the university.

so sad this has carried on so long for all involved

Police found a marijuana grinder in his apartment during search. Doubt he'll ever be back at UT. IMHO.

Yea I'm so glad we are nothing like them. They have won more games in a row than we have won total in the past 5 years!!! HAHAHAHA sucks to be them!

If that's all you got from the comment about being glad we aren't FSU then you might as well join them.
I'm glad Butch is willing to do what's right and hold players accountable

And it's not admissible as evidence 99% sure. It would take one of the most eloquent arguments ever to get past relevance and prejudice objections. Also would probably be suppressed anyway.

Due process only applies to the government giving it to you. Where you work or where you go to schools don't have to afford you it. Nothing for the ACLU to do.

Wrong. UT is a public institution (so when you say 'applies to government', that includes public universities, as well as k-12 public schools) and as such is legally bound to respect the constitutional rights of students.

The University of Tennessee is a state funded institution. In other words, it is the government, and it must afford citizens due process like any other government entity. The question is does the student disciplinary council (or whatever it is) count as due process? It probably does because AJ accepted a scholarship in exchange for following the rules and guidelines of the University. Moreover, there likely is an appeal procedure on any decision much like an administrative type decision from another state agency like Game & Fish, DHS, etc.
