They have potential remedy, see Trump v JGG. The issue was where there was irreparable harm i.e. Obama murdering Americans imo.

You're arguing the Law shouldn't be the Law but that is the Law.

At least we haven't let it get to the place where Habeas is suspended, its better to fix this now before it gets worse, imo.
I am saying the law is the law and it should be followed as the law is written. not as the admin wants to implement the law.

the POTENTIAL remedy has an issue. it only applies if the mistake is caught BEFORE they are able to stick someone on a plane to a foreign country. after that point you have maintained that the US has no jurisdiction what so ever. so even a citizen would be SOL in your argument once they hit El Salvadoran ground.

It looks like it to me on the surface, but that is why you have judicial review. The administration has never said that there can't be judicial review, and if it goes on long enough... someone will probably get there. Right now though, justice seems to be served. If someone has a problem, I'm all ears... but these people haven't really brought any goods to the show.

Most likely the U.S. won't have jurisdiction or could potentially lose jurisdiction as the subject is gone. An American probably could take another crack by being denied re-entry, just my take at this moment.

ICE did not arrest anyone. A FL state trooper arrested him for supposedly breaking a FL state law.


A Florida Highway Patrol trooper arrested Lopez-Gomez after a traffic stop in which he was a passenger. The 20-year-old is set to remain in jail for the next 48 hours, waiting for federal immigration officials to pick him up despite his first-degree misdemeanor charge being dropped.



He was born in the US, but moved to Mexico at the age of 1. His first language is a rare Mayan dialect. The chance that the State Trooper was targeting US citizens is microscopic.

The 20-year-old’s first language is Tzotzil, a Mayan language, and he took a long pause when he was asked if he wanted to hire a private attorney or obtain a public defender. He lived in Mexico from the time he was 1-year-old until four years ago, when he returned to Georgia, his mother told the Phoenix.

The judge doesn't have the jurisdiction to release him, due to DHS's request. I am assuming he will be released once DHS has verified all the facts.

The Homeland Security Investigations Office in Tampa issued the 48-hour ICE detainer on Thursday. An ICE officer whose name and phone number appear in the detainer refused to speak with the Phoenix.




The fact that he's had a court appearance is proof that he's getting due process, and it's making the opposite argument than you want it to make--i.e. this administration is trying to just whisk citizens out of country with no procees/recourse. Every fact in this case is the opposite of this claim.

I don't know about the arrest, but he should be released as soon as citizenship is proven. ICE needs to take the judge's word for it.

What's the Law on this? I would think it would depend on the amount of time, but I kind of a devil is in the details. Florida would be on the hook as he wasn't in U.S. custody I would imagine.
 
Is the detainer looked at as probable cause? (Idk) I think that and time are the factors here.

From the info posted above, I suspect that a car full of Hispanics was pulled over. The US Citizen in question spoke in broken/poor English with a heavy accent, and had no documentation to prove his citizenship. That's likely probable cause, but I'm no attorney.

Sure but he should have been released immediately once he produced his birth certificate.

They picked him up and in a court room scene that could only be described as Larry Davidian, his birth certificate was being waved around but the judge apparently said her hands were tied.

Sounds like they just released him lol.

correct, ICE didn't arrest him. my bad. they just requested he be detained after the initial charges were dropped, AND his citizenship was proven in court.

I don't know if he went in front of a judge. it just said an advocate proved his citizenship with a birth certificate. but even after that he is still being detained by ICE.

I see he has been released. removing this part about what else is left.

It says the judge inspected his birth cert. He's getting due process. Part of it may be ****, but he's going through the system, and I'll bet you a fancy dinner he's released.

I think he has been released now. but it wasn't just a couple hours after the judge reviewed his case.

the issue is that the process worked this time. but you still have people like LSU arguing that there is no process, AEA, and the government can deport as they want.

I personally don't want to see an American deported only then for the government to say "oops", and try to fix it. as people point out with DOGE, its only been 3 months, and we have already seen ICE detain an American.

I think the admin slowing down, and reevaluating their operations is a wise step at this moment, before it gets worse.

My research of the case you posted indicated that ICE has detained almost 2000 US citizens in the past 15 years or so. It's nothing new. It's been happening, and it seems that there is a system of protection wrapped around it.

I'm not sure of LSU's full argument, but the ADMIN's argument per this El Salvador case has been that their hands are tied b/c it's an ES citizen in ES. Personally, I think you're blowing this "US citizen" fear-mongering out of proportion. We've seen nothing to indicate that random US citizens can/will be shipped off to foreign countries with no due process or ability to bring them back if (God forbid) it ever did happen.

And FTR, not even the Trump admin has said that they can "deport as they want". They have been investigating every legal method available. Stop and think... EVERY LEGAL method available.

Even your fears per US citizens. The admin made the stupid comment that they are what...? Researching the legality.

Good news. Birthright citizenship should only apply to children of US citizens. Hopefully the court helps to move toward that direction.

I think every person that is wrongfully arrested for anything should be able to sue and win monetary damages. I almost sued myself when it happened to me, but they released me before they actually hauled me to jail, so I let it go.
