I don't think I've denied that. I'm questioning that claim that the courts said that he is here "legally", which I've seen no indication of.
thats fair. I have said for a long time the guy is going to end up deported. but just because its going to happen doesn't mean the government gets to ignore the process to deport him.

1. even on the AEA the SC court said they had to follow the process, because they didn't. they jumped between two processes. Started with immigration and then used AEA without going thru the AEA process. this has been pointed out ad nauseum.

2. AEA isn't immigration. and vise versa. Immigration laws result in deportation. AEA results in REMOVAL. you would know this if you actually read the law I have quoted and linked, but you continue to lie about.

the government is claiming to have DEPORTED him, that means immigration process. which wasn't completed. as noted by the SC
if the government wanted to REMOVE him per AEA, that means the AEA process. Which wasn't completed, as noted by the SC.

I am just making up percentages here but the government got 75% done with the Immigration process. then finished the last 25% with the AEA process. there is no LEGAL method of doing that. period, end of debate, Supreme Court says so. if they wanted to use the shorter AEA process, they should have started at the START of the AEA process, instead of starting AEA at mostly being done with immigration.

A deportation order, thru immigration, is not cause for removal under AEA. the cause for the deportation order may be cause for removal under AEA, but that still has to go thru the AEA process. but the deportation order alone doesn't meet the qualifications for AEA, which is why the Supreme Court noted the process.

Sure they should follow process, but at the point they were handling the injunction the court didn't have jurisdiction. Whether he was already to be determined to be illegal under immigration law is not material, see AEA.

The Supreme Court in this case is only dealing with immigration process, the AEA ejection was already done and no habeas was filed. So, they can continue the process there but he has already been determined to be illegal in that process.

He was sent there illegally according to the SC. It is our problem if our gov't sent him there illegally

It is debatable whether we can get El Salvador to give him back. I think we could tell them that we want him back but I don't think the Trump administration is doing that. Admittedly that is speculation on my part and not fact
Does anyone in this thread seriously believe El Salvador would refuse a request from President Trump to transfer Garcia to United States custody?

The right question at this point is, will the U.S. contact the El Salvador government and ask them to put the terrorist in the parking lot so we can hit him with a Hellfire missile?

At this point, I would buy Trump lunch at McDonald's for week if he did it.

"If a non-personal email — such as an American citizen contact — was provided by the alien, notices may have been sent to unintended recipients," the officials said. "CBP is monitoring communications and will address any issues on a case-by-case basis."

"To be clear: If you are an alien, being in the United States is a privilege — not a right," the officials added. "We are acting in the best interest of the country and enforcing the law accordingly."

Since when does the govt provide notice of anything like that by email? They should have put it up with the story.

They don't send official notices by email. It was a scam email like the ones going around from the "IRS" or your local sheriff about missing jury duty.

A mistake? But you guys have already ruled thru AEA that there is no process. Best course is to deport her, and then maybe see about fixing the issue.

I don't fully understand this quote from the article, looks like something was left out. I'll stand by my statement that this was not an official notice sent by DHS. If it was the author would have put it in the article.

unless AEA notice is sent to an American. and they are removed from the country before they see the inside of a court room. and then your argument is once they are out of the country, its too late, and there is nothing the government can do to fix it because we don't have jurisdiction.

thats a nightmare to me.

I get his point, if the illegal alien gives out an American's email as their own, it creates an issue, but its not going to be a unique issue to email. the illegal alien could easily give out someone else's address for a paper version of these notices. and at that point the government has done pretty much everything they have to before they can summarily remove a person from the country under AEA.

They have potential remedy, see Trump v JGG. The issue was where there was irreparable harm i.e. Obama murdering Americans imo.

You're arguing the Law shouldn't be the Law but that is the Law.

At least we haven't let it get to the place where Habeas is suspended, its better to fix this now before it gets worse, imo.
