Whewww. Apparently Belichick let him know before his interview that Giants were going to hire Daboll, and that he being used just for the Rooney rule... So now he’s suing the NFL. If Belichick has proof of that than Flores is probably about to get paid.
I’m confused as well as to the theory of recovery here. Why are his damages for being subjected to a sham interview other than his time lost giving the interview? The Giants having already decided on Daboll before interviewing Flores isn’t discrimination. How does one have a private right of action for the violation of the Rooney Rule? Seems like the league could fine the team for violating it, but that wouldn’t entitle the prospective coach to damages for it. Maybe there are other theories in the Complaint alleging that he was discriminated against for his race, but that’s not established by the Giants wanting to go after a hot OC commodity like Daboll.Who knows. His contract didn't have a dang thing to do with his ability, Marino was the best pure passer I have ever seen...and that doesn't have a dang thing to do with what his crappy team did or didn't accomplish.Maybe......But Marino has a losing record in the play-offs and handcuffed Miami by refusing to alter the offense to be more multi-dimensional.
He absolutely is one of the best pure throwers of the football…….no question about it. But lots of numbers don’t make you one of the best of the best. Definitely top 20 all time (my opinion) but not a top 5 that a lot of people think. Thanks for the insight.It’s a proposed class action, so the expectation is that others will join in. They don’t specifically have to prove anything having to do with the Rooney Rule because that’s just a league policy. But if he can prove discrimination, then he might prevail. It’s not my area of expertise, so I am just generally speaking.
The Giants organization just seems incompetent. Not sure why you would ever let any decision makers openly discuss a hire before everyone has been interviewed. Now you see why the league tries to put policies in place league-wide because there are some franchises that are just very poorly run than can affect the entire league.
I guess Flores could be kept out of the league, and he surely got legal advice about the future of his career. But it’s a bad look regardless of if he gets paid or not, and I would think the league will be swift with dealing with it. I would think he would find himself employed again.
