Just for snicks and giggles, have you considered one's position in court if an MOU was actually signed for a position that had yet to be vacated or for which a contract was already in force and being executed? To make it easy, CBJ would have a slam dunk that he was undermined, UTAD had violated his contract for this season the minute they entered into negotiations much less signed an MOU for a position, contributing to the poor season over which they were now trying to dismiss him!! It would be a slam dunk for CBJ and perhaps with treble damages.

Just do the slightest practical reality steps you would use in your professional lives and apply it here. Once you do you can rapidly separate the soons from the loons IMO.

Butch is well-informed and under an agreement himself. This process is more about language than formal agreements, specifically, the MOU. This is a very dynamic situation, but if handled appropriately, Butch can't retaliate through litigation. I don't trust the administration, but I trust the process and legal team.

So upset. Doug Matthews is saying he is not so sure Butch is gone and is still coaching for his job. He says we are so close to becoming Nebraska, and he thinks the future firing/hiring decision will be made by one person(Haslam). So does he not know or are we being fed lies, again.

There is no way Butch stays. The fan base would burn Neyland down.
 
Seriously, rest afterwards. I took 2 days off and just laid around the house. A friend of mine had it done before me and he tried to return to work the next day, he was miserable for a week.

This. Follow their instructions and don't try to be a tough man hero

From a friend:

I was told tonight..."We got Gruden...done deal." Came from same friend who told me about the Ergen deal. I don't have a timeline but that Gruden will be announced shortly after Butch is publicly fired. I was told this is to a point it can't be undone. Take it for what it's worth.

Sounds like he just read this thread and then sent text.

I have no idea the timeline, but one would think Gruden would want to get started as soon as possible so as to begin to try and salvage this recruiting class before the Dec signing period.

I think Gruden would have to stay with MNF until the end of December. Just wondering how that works with the early signing date.
 
I don't completely disagree. But your premise is that Butch has not already been informed he will not be coaching next year. I don't know what he's signed or if an agreement has been reached, but I'm confident Butch knows he's gone. Hence the zero recruitment efforts for the last month, and official visits being canceled or moved back.

If that's the case, it changes things.

There is no way that good legal counsel would allow anyone officially with the UTAD be in the position of negotiating a contract with someone else before the other contract in force and executing over time covered by the executed contract is underway. Could an unofficial contact or cutout attorney be doing these things? Yes. Would a paper trail of a signed MOU with someone else, be allowed? Hell to the naw!!! Think people or fire your counsel, he/she is incompetent if they cosign crap like that and I can line up lawyers from here to Timbuktu that would take CBJ's side and prevail for a minimum of treble damages.

I think this is spot on. The only caveat to this for me is that if Gruden is on board & if he has signed an mou then I see no way its kept quite til the end of the year. Which means, if hes signed & you want to control the message then an announcement on CBJ & CJG would have to take place very soon & very close together. And don't discount the early signing period in all of this. No CJG then you keep CBJ til after the early signing. If you have CJG then you move before
Honestly a good way to end this is at the very end of the season. Butch will not resign due to the buyout ordeal. However, I would not be surprised if at the last game on Sunday or Monday it is announced that he is no longer coach.

That is my anticipation now that the big picture has been explained. Young and Hun ho! Lol.

A year is a long wait for a once prideful vol fan base.. next year.. if gruden is hired.. wait.. WHEN Gruden IS HIRED.. we can honestly say, Tennessee is back. And mean it.



Butch beat Florida. That's one thing I like about him. Bone headed play calls has honestly screwed him out of a job. 2 seasons we COULD have been 10-2 or better and been to the playoffs. 1 play changes the game on a lot of games over the past 5 years. Don't get me wrong...I want him gone as bad as anyone. But let's face it.. realistically, unless he Jack's up really bad.. late November early December is looking like our date folks.


And by the way. Congrats to the fella whom just become a dad!

Some lawyers discussed this several threads ago. Contracts (& buyout agreements) can be written with all kinds of different effective dates.

An MOU is technically a non-binding agreement if I remember correctly. It simply states both parties understanding of a requirement or future contract. This is not uncommon. I would imagine butch has signed a similar or even more binding letter of his own stating he knows his tenure is done at such and such at date. It is not unreasonable to interview and perhaps even unofficially hire a replacement for a unique or skilled position prior to terminating the current seat holder. You don't fire your CEO without exploring options.

Not if CBJ has signed his early resignation letter that includes him landing a new coaching job somewhere else.

This ... mutually agreeded upon terms from all parties
