I always respect your thinking here but IMO going D2 isn't really having options

Also there is 0% he would get a waiver IMO

We will have to agree to disagree on this one, I watch the NFL combine every year...and further, most certainly if he is forced to go that route UT will be sued for it. That is the very definition of irreparable damage and as long as he plays, that suit can go on however long it takes...of course I'm not a lawyer so I'm probably speaking out my arse. :)

Going D2 or NAIA is certainly better than not playing. I agree
 
it's not like von hasn't gone unpunished. he got 3 months suspension from school and football. put him on the field announce it and be done with it. if ut doesn't put him on the field i hope he sues and wins and hart and cheek both get fired because of it.

Von Pearson was not.

Michael Williams and AJ Johnson were charged with two counts of aggravated rape.

Von Pearson was NEVER charged with anything. Period.

Michael Williams and AJ Johnson were INDICTED.

Von Pearson was not dismissed from the team, not charged with a crime, never was arrested and the case against him was dropped by the DA.

AJ Johnson was NEVER suspended from school. He not only graduated, but he took part in the ceremony and was allowed to walk.

Michael Williams, as of about two hours ago, is STILL an ACTIVE student on the UT campus.

What policy has Von Pearson violated that he was suspended FROM SCHOOL in the first place and the other two were not?

Why was his suspension lifted and then put back in place and while I'm on that topic, why is the OCR here and both of those questions lead to one name and why does he still have a job?

The only logical answer is there was an act committed by VP after the original incident that caused the "victim" to have real fear on camPus. Perhaps he threatened her or something similar

Now if that or something similar didn't happen then your thinking here is correct but it could have happened which would explain the discrepancy

I can assure you, if there was a second act committed by Von Pearson, don't you think Coach Jones would have booted his butt immediately and we would not be having this conversation.

In fact, let's try it on for size...every coach uses the same phrase..."we're gathering all the facts"...right?

Well, lol, it's been almost 5 months. Coach Jones knows everything there is, don't you think? Obviously we are talking about two different situations with Williams/Pearson but here we are...After CBJ gathered "some" of the facts in the Williams case he dismissed him. After he's gathered "all" the facts in this case to the tune of, "not enough evidence to prosecute, Pearson is on the Roster and STILL suspended from school.

I would doubt a few phone calls to the victim would be enough for cbj to dismiss him and that would be enough for a dismissal from school IMO

I refuse to take either side of the argument because their still isn't enough data for public consumption.

I trust CBJ. He's been quiet - to the public. I'll bet he's got a pretty good handle on what really went down. Other players were present. I'll bet they have had a closed door meeting with Butch, as well as VP.

If CBJ is going to bat for VP, it's behind closed doors. He may be having a knock down/drag out with Cheek right now, and guess what... YOU will never ever know.

One day, there will be a presser and a decision will be made, and this thread will dry up and blow away!

Just hypothetical

I posted yesterday that a buddy of mine that has experience in these things said that many times a kid is suspended from school not because of the original act but what happens afterward that makes the "victim" have fear. He used stalking trying to get the person to recant as an example.

Ask your buddy if the police (KPD/UTPD) would know, the DA, the school, the coach, the defense attorney, ask your buddy if they wouldn't be sharing that info over this time lapse and see what he has to say. I'd be interested to know.

I will but I assume it would depend on the severity of the act.

A few phone calls would be just more he said she said if the victim claimed threats were made. Without a restraining order I don't know if those acts would cause much reaction by anybody other than the school removing the "fear" which is required if my understanding is correct

Let me know how it goes. In the meantime I'll keep wondering why we aren't burning mattresses and starting petitions...kidding of course...all i can say is that listening to Hubbs, Hyams and Wilkerson today, all guys that traditionally let things play out but always side with good ole UT were having a really hard time doing it.

And I should say, I don't wish any personal malice on Williams or Johnson, but it is just hard to square why they were allowed to stay in school through their endeavors and Pearson was not.

I've seen stuff that indicates a change in policy, stuff that has to do with how the accuser presses forward, but...where is the leadership?
 
Maybe Johnson and Williams were allowed to stay in school because their accuser left school. VP might be suspended because his accuser is still in school.

That might have been a plausible theory until last Thursday when the University received the rape kit results, which I might add, was a complete rape kit because as Hyams reported, Pearson volunteered his DNA.
 
I have a feeling the powers that be were relying on the DA to bail them out and now they are caught with their .... In their hand ( pun intended) and had no plan as to what they were gonna do if no charges were filed.

Von's lawyer sent a clear message to the university today. I look for him to be cleared by tomorrow. If not the university will have to defend itself against a lawsuit that could get very ugly and be very costly.

Don and Chris Coffey are among the top criminal defense attorneys in Knoxville. If they wanted to get their name out there, they would have kept this case in the headlines all spring and summer.

My guess is that it's strategy. With UT under federal investigation, the university needs to show that it has thoroughly reviewed all evidence and finalized its own internal investigation without undue influence. Taking several days to complete the process while the attorneys are turning up the heat puts UT in a better position. JMO.

A negative rape kit isn't necessarily proof of innocence. The accuser might still be claiming that VP did something to her.

That's right, but in their arrogance, they don't want it to look like that. Fine. Now do the right thing.

Or...watch it all leak out a drizzle a day because now that the legal side of this is done, the Pearson camp can tell the story, their story, without ramification.

Volunteering your DNA with so much on the line is significant, no? Leg to stand on comes to mind...as in the DA didn't have one, right? What Leg does UT have to stand on when you compare Williams/Johnson to Pearson?
 
No, but it's about the strongest legal evidence, especially with DNA.

UT doesn't operate exactly like the legal system. Student disciplinary board. Plus the Feds are snooping around. And the Tennessean is stirring up ****. And a faction of the "Lady Vols" are putting on the pressure. Cheek is a weak leader. Von's not in the clear just yet, but the Hubbs comments are encouraging.
