Your guess that he won’t win is as likely as anyone else’s guess, but he certainly has a case. There are countless examples of the NCAA awarding an athlete another season of eligibility when they missed part of a prior season. While the NCAA has written rules on how many games athletes are allowed to play prior to the injury, the NCAA regularly approves exceptions to those rules. It’s possible that a logical minded judge would view those inconsistencies as rule in ZZ’s favorI don't. He has no case at all other than "I want to play more." Until the 5th year is granted to everyone (if it gets granted), he really has no argument.

The article recites the NCAA's arguments. The article itself does not opine as to the strength of the case.NCAA Fights Tennessee Hooper’s Request to Play a Fifth Season
This article is definitely worth a read. I won't quote the whole thing, but there's some pretty good points in here as to why ZZ has a weak argument IMO

They're OK to release in the aggregate -- or at least they used to be....I recall something like 99% of Pat Summitt's players graduating.Grades are always private from the public according to Title IV
This is what I don’t understand either. They literally had their teeth cut when NIL comes to life. Can easily see the DOJ getting pushback and denies the statement.I’m a little confused about why the NCAA would spend money trying to fight any of this. It literally costs them $0 to just cave and it doesn’t seem like they have much of an interest in restricting eligibility for the small number of players looking for a 5th year right now.
Anticipating the NCAA to act rationally is never a good ideaI’m a little confused about why the NCAA would spend money trying to fight any of this.
