Von Pearson WILL NOT be charged

From a legal standpoint Von HAS been presumed innocent. He was never charged with anything nor arrested or imprisoned. The rules of the University and/or the rules of our football program have absolutely nothing to do with our legal system. Just because Von isn't being charged with a crime doesn't mean there wasn't conduct unbecoming, which if there was I'm sure it is in the case file. I'd say before the University makes a decision one way or the other they will want to review it themselves. There's plenty of things you can do to get yourself kicked out of school that aren't illegal.

Granted, he was never arrested, charged, nor imprisoned, but because the "investigation" was dragged out so long and he had this hanging over his head, the university and/or Coach Jones have been prevented from making a final decision regarding the permanency of his suspension. My contention is that this in itself is a violation of Mr. Pearson's rights as they were originally conceived by our Founding Fathers.

But I agree that his legal rights, on the one hand, and university and team policies on the other are entirely separate matters (see my later clarification).
 
There's clearly more to this story than anybody here knows about.

And it would be so much easier if everyone would just understand that. All we know now is no criminal charges. Was there enough for civil charges? Enough for title IX to be violated if he's reinstated? Did he do anything at all?
 
Neither can it be expedited simply because Von is a football player. The process will take it's natural course like it would with any student in this situation. If that process takes a week, two weeks, or a month who knows. However expediting it just because Von plays football is just as wrong as there being a "lack of urgency."

I didn't mean expedite it because he's a football player. I just meant to get on with his life. If the issue the Admin needs to discuss is the "environment for other students" as some have speculated, then they should let him transfer to another school where that won't be an issue. No reason to hold him hostage and in limbo when he could be continuing his education somewhere else.

I wouldn't read too much into that. It's quite possible that Von requested a temporary reprieve from his suspension so that he could take finals, with full knowledge that the suspension would be put back in force as soon as he finished the exams.

The article DID NOT say anything about being lifted temporarily. Von thought it was lifted pending any further adjudication so I AM reading into it.
 
As I noted in a previous post, Von had his suspension lifted and two days later a single individual re-suspended him. That indicates to me that this individual could just as easily and quickly lift the suspension again.

You could be right. I do hope that ultimately there was no wrong doing on Von's part and he indeed is allowed back in school and on the team. I'm just not ready to believe in all the "cloak and dagger" conspiracy that so many seem to believe.

I didn't use to believe in that sort of thing either but after being around for 50 years, I think anyone would be foolish NOT to believe in that sort of thing these days.

One that comes to mind immediately is the fact that all Americans are supposed to have the right to a speedy trial. Implied in that is the length of an "investigation" into the facts or lack thereof concerning accusations made. It should never, EVER, take four months to gather "facts" in a case like this and four months emphatically IS NOT SPEEDY by any reasonable measure.

Also, all Americans are supposed to have the right to be considered innocent [meaning that they are not supposed to be PENALIZED prematurely, which Mr. Pearson most assuredly has been] until proven guilty.

As it has been stated before, the right to a speedy trial attaches once charges have been filed. As an aside, almost every criminal defendant waives this right.

Sometimes investigations go on for YEARS. Think about financial fraud or EPA cases. The investigative portion is extremely tedious and time consuming.
 
Here I thought I might find some updates on Von, but I see the dumpster fire from that other thread has spread over here. Aside from the statement by the PR guy that was posted earlier in this thread, has there been any other word from the AD or University?

In THIS particular case, no I personally don't believe it. I simply think the University is going to do it's due dillgence in evaluating the case file and deciding whether or not Von deserves to be reinstated. That will take a little time. Again, just because Von has been cleared of any illegal behavior doesn't necessarily mean there wasn't conduct unbecoming. He's fine from a legal standpoint but in terms being a student and a football player at UT, he's far from being out of the woods yet.

Holding a young man's life in limbo for this long is what is criminal. Wouldn't blame him for wanting to get the hell out of Knoxville. The whole damned UT administration system should have to answer for this travesty. This is how the UT football "family" is treated...guilty until proven until...o.k., that's enough? :thud:

@GrantRamey: I'm told that Von Pearson does have a fall class schedule. Just a matter of getting cleared so he can attend those classes.

LOL! It's LITERALLY been less that 24 hours since it was announced that Von wouldn't be charged with a crime. How exaclty has his life been held in limbo?
 
OR, that violence against women is a huge issue in the NFL and on college campuses right now (135 investigations on 121 campuses), specifically with football players.

Therein lies the issue. Goodell underestimated the public backlash when he suspended Rice for 2 games and there were countless people calling for his head. In today's climate, no one is going to go out on any sort of a limb, especially a university employee. Erring on the side of caution is putting it mildly to say the very least.

Of course, the public attitude in this county is beyond hypocritical. Ray Rice said in his interview yesterday there is a case of sexual abuse every 12 seconds in America. That's a lot of laws being broken, a lot of people hurt, and you can't blame but a miniscule fraction on pro or college athletes. But, you don't hear crap about any of that except for the high profile cases found in the NFL or college football.

I guess this makes America feel like they've done something...then thousands upon thousands go home and abuse their wives or partners.
