Von Pearson WILL NOT be charged

If for some reason that UT doesn't readmit Pearson... He should lawyer up. There is NO reason to NOT readmit him. HE DID NOTHING WRONG, according to the courts.

The only thing he needs to be "reminded" of is not to get in that situation again!!

There were no courts involved and if more evidence surfaces he could still be arrested.

They have treated him like a depraved sexual predator this entire time. They let Michael Williams, who was arrested and charged, take classes. I think the alleged victim is the daughter of some high ranking UT official or something.

Accused of rape. Rape kit was negative.

Now maybe he did something terrible and got away with it but everything is pointing to him being innocent. I maybe totally off base but I've heard the standard of evidence necessary for charging and indicting someone is very low and Von was never charged.

I think I know what you are saying, but honestly this is not true. The old (incorrect) saying "you can indict a ham sandwich" leads people to think that, but has more to do with the way the system works than the strength of the evidence (only the prosecution presents it's case, so most prosecutors worth a damn can convince a GJ to indict).

The standard for filing formal criminal charges is that the DA reasonably believes that the evidence would support a jury finding that each element of the alleged crime is proven beyond a reasonable doubt.
 
I would like more to come of this. The accuser needs to be disproven and charged with malice. There has to be consequences on the back side of this or this is going to become a recurring theme. This is bigger than football issue. Just gets a lot of attention in the sports world

Something similar happened in north west Arkansas. A player (I think) was accused of sexual assault in a parking garage. Evidence proved he didn't do anything at all. The woman was later arrested for filing a false police report.

So I'm assuming you didn't go to law school, but in the United States we have a "presumption of innocence" which basically means that a person is innocent until proven guilty. So yes, the fact that there was literally no evidence to establish probable cause to charge does mean (in the United States of America) that he is innocent of the accusations. Frankly probable cause to charge isn't even that high a burden really so that they couldn't find that is pretty indicative that there literally was no evidence whatsoever to support her claim. The bigger picture is that our system of justice works, an innocent person won't stand trial for a crime he did not commit, and the world will keep spinning.
i don't have any issue with this, i know we're 'presumed innocent in the eyse of the law'.

maybe i'm just stuck on the verbiage used. "insufficient evidence" sounds a lot different than "cleared" or even "found no evidence to support pursing the case any further".

to me, it just sounds like code for "we know what happened, we just can't prove it".
 
Sad part is, no one will know he's been cleared. You know, because you are always cluttering up the update thread, how would they possibly find out. :blink:

I went over there to talk about the new Star Wars movie...they mentioned it. :)

The University doesnt have to have charges from the DA. All they have to do is reasonably determine that he broke the code of conduct. He has a little more to go before he can get back in the classroom and field......hopefully sooner than later.
