VA battle

What was the issue?
So many to list... but what I'm going to the Judge for is, I was hurt in a Helicopter incident that crushed disks in my lower back. That was back in 92 just before I got out. I couldn't take the pain any longer in 2000 and went to the VA for help, they told me they lost all my medical records and if I didn't have them I was out of luck. They found them, (as per the VA) 3 months later and didn't call me back in until I went back for other reasons in 2011. As per the VA laws/rules, they were supposed to call and set up an appointment as soon as they found my records. They didn't. Plus so many other things to long to list.

I went out from injuries in a helicopter crash as well. I didn't have these issues with the VA and that really sucks. I hope you get the compensation and help that you deserve. No ideal why you didn't go to the VA day one of being discharged. You would have been receiving your compensation from day 1.

Its a crime that vets have to go to the VA.. Should be able to see anyone of their choosing and doctor should be able to bill for services through the normal EMR billing services

They need to get rid of the VA medical facilities that they currently have and go to this system. Unfortunately, since so much money is sunk and tied into the VA Healthcare system abd facilities, there isn't a chance in hell they will go to a system like that.

Long story short. In 2000, I started my odyssey with the VA. June 13, 2017 I will finally get my day in federal court in front of a judge in DC, via a video camera.

Thanks to the DAV.

Good Luck All Vols...Hope the ruling goes in your favor, and you get a nice big fat check of back pay

Found out Friday I was denied again for the tumor and headaches. Now after waiting 3 years for that ruling, it's time to appeal yet again and add all the new information out there that has come to light that proves my case. The VA keeps closing their eyes to it.

Are you using a lawyer?

2 years gone by now. I won my case. 60% still waiting on the brain tumor rating. See ya in another 2 years.
At 70%, you will get free care at a VA home the rest of your life, at least shoot for that.

I thought I was at 60, right now I'm at 50%. Since they keep denying the tumor, even though they lost all my records and as per the "Federal Judge, they can't deny me because they don't have a leg to stand on." They denied me anyway, forcing me to gather more evidence, and more time in the appeal process. What they are hoping for is that I, and many vets like me die before they admit they screwed us. <-- my opinion.

Last update, and it's a good one. Are you ready?
I have won my case. (60 percent now, this will go up, because they missed the migraines I suffer from the tumor.) As per my VA rep and friend who helped me more that anyone else, says I have set "Case Law" he made a huge deal about it and what that means.
To me, it means other Vets going forward with certain brain tumors such as mine is now considered presumptive and the VA can no longer deny Vets like me any further help. It's nice to know , going forward and once I leave this earth, my name will be somewhere in a law book somewhere helping future Vets.
Thank you Lord.
