Sigh...

Do you people even listen to what you're saying sometimes? The guy that was tackled as he walking away was the who escalated the situation...

I agree with your view partly regarding this situation based on the short video. I do not believe the cop should have "tackled" the guy. Based on what I could see that wasn't needed. I will however disagree with your assessment that he was walking away from the situation. It was fairly apparent that was not what he was doing.

Edit: based on his fashion faux pas and his singing ability maybe he did deserve the unnecessary roughness. 15 yrd penalty on blue, automatic first down.

So.... since no one will ask the question, I will. If it was illegal, how did the attorney get away with it? How did the judge get away with it? Both are clearly guilty, and the last story I posted is strangely similar, the only detail that is different is the guilty party doesn't work for the state.

Now, before any of you start hollering about compassion for the families. It's not about compassion, it is about justice being equal to all. Isn't that what most of you preach here? Horrific incidents all, but the treatment was very different.

A couple of last thoughts then I'll move on. You guys are assuming I think there should be no punishment if the guy has broken a trespass. That's not at all what I'm saying. What I'm saying is that violence should only used by law enforcement when there's really no other option. We were no where near that point in this situation.

Though I do believe the guy had turned to walk away, I'll admit that I can't say with certainty that it was the case. Either way I get the impression the justification for the take down was based on the guy touching the officer first. That's simply not the case.

I can't disagree about the singing. It was down right horrible.

You are correct on both points. Justice should be equal for all and the same goes for punishment. And it's not. In all honesty it's sad that some can get away with it like they do. Politicians and corporate giants alike.

For the record, it appeared the guy was turning to leave to me as well. It would've helped if we knew the layout of the restaurant.
Interesting thing though, the two chaps that approach the man were obviously security. If you have security, why involve the cops?

I'm guessing it's a trespassing issue. He's probably been told to stay off the property before and warned of what would happen if he returned.

There was a case like that in Nashville a couple of years ago. Mother left a baby in the car and didn't discover him until she went into the church to pick him up from mothers day out. She wasn't charged if I recall

He looked as if he got angry as soon as he saw the cop and the guys in suits which leads me to agree. Regardless, it was a little bit too rough IMO unless the guy has a reputation for being combative. That guy is mentally irregular and I can see how he could get on your customer's nerves

Also interesting that nobody minds them lying to help jusyify the officer's action. I'd be interested to see how the same crowd reacts when a bystander lies to make LE look bad. My guess is, in that situation, it's far from okay.

I'd also like to take a moment to point out how much I hate the media in this country. I was looking a little further into this and here's a few of the headlines...

Shocking moment... police tackle man to ground for singing Beach Boys songs.

Pennsylvania police brutalize man for singing.

Cops body slam elderly man for singing Beach Boys in public.

We all know where I stand here but we're not helping anybody by making stuff up. The headlines should be...

61 year old man aggressively arrested after trespassing. Use of force questionable, judge for yourself.

61-Year-Old Man Violently Attacked by Police and Arrested for Singing a “Beach Boys” Song | The Free Thought Project

Yet another example of the police turning a non-violent situation into a violent one.

Not only did the officer not "throw the first punch", the guy was freakin walking away. When will they learn that cell phone cameras are ubiquitous and the "he started it" lie they were taught in the academy isn't gonna work anymore? Somebody needs to make a meme using the Maury picture that says... In the report you stated that the perp touched you first but the video you didn't know existed of the entire situation shows that was lie.

Cop should be fired immediately and then arrested and charged with assault. The two guards should be charged with at least making false statements if not obstruction of justice. Also, once fired, the cop should be on the hook for the civil suit instead of the tax payers.

We deserve the people that "protect and serve" us. I dont care if this was the 100th time he's done this. Was it really worth a takedown and the lies/cover up afterwards?

I think we have violent cops because we have some very thin skinned and easily annoyed people in this country that absolutely have no problem with calling the cops on the most trivial of annoyances and expect some level of violence to be applied to the perp.

I looked around and found a few similar situations where they didn't charge someone or dropped charges....if it was bc of the position they held then it is reprehensible but I'm not sure charging someone is the way to go.

Agreed

Jesus... I can't say why I'm bothering as you will either ignore blatent video evidence or perform the most insane mental backflips so you can find a way to rationalize it but here we go I suppose.

The security guards were telling customers that the old man made first contact and that's why the cop took him down. Agree or disagree with the cops actions, that's simply not true. Now I'll openly admit I don't know this for fact but I'm betting they made statements after the arrest that were along the same lines.

The guy turns (to walk away in mine and pretty much everybody else's opinion but whatever) and the officer reaches out and grabbs his shoulder. He does try to shrug the officer off but I think that was instinctive and not intentional. The reason for that is cause after that he immediately raises his hands, I assume, to surrender. Cop had already decided violence was needed and took him down.

It's somewhat confusing really. If the officer's actions were totally righteous, why did the goons need to lie about what happened? If they made official statements of the like, then that's clearly making a false statements and borderline obstruction of justice.

Now those charges might be a stretch buy so were the disturbing the peace and resisting arrest charges they dropped on the old man. Kinda hard to see how a guy with his hands up is resisting arrest but what do I know?

Not the greatest quality as I just paused YouTube and took a screenshot. Either way you see his arms extended out as he's being taken down.
