If you shot someone as an "oops" it's entirely possible, in fact almost a certainty, that you wouldn't be facing a "murder" charge as you suggest.

Now, if you want to say there's damn skippy some culpability involved and "oops" just isn't good enough...you've got a pretty good argument.

I would imagine that the prosecutor there is charged with the duty to determine if criminal charges are warranted. I don't think you can get that from an article like this, though.

Kudos to the Sheriff's Office for sorting out what happened and admitting the mistake.

If it was an unintended result what else would you call it?

The issue shouldn't be the intent. (Unless you think the man was shot on purpose even though the knew he was innocent of wrongdoing) No, the issue is what are they going to do about what happened? If you run over someone in your car by accident it's a "mistake" right? You didn't "murder" anyone but you DID kill them.

There's culpability here...they've admitted it...now we see what comes of it.

I'm not a cop obviously and am not familiar with the particular town/force in question, but I would think having to shoot at someone twice in two years would be a bit out of the ordinary. I'm sure it happens from time to time, but I would imagine it is by far the exception. And a 93 year old?

It's a shame for the victims, and it's a shame that bad cops come to represent police forces in the minds of so many Americans because of incidents like these.

Most cops go whole 25 plus year career without shooting someone let alone two! And over 4 months of that time he was on paid administrative leave awaiting a decision on his first shooting.



I don't know if you've noticed, but more and more cops are declaring ANYTHING that frightens them an "immediate" threat and simply blowing people away.

when a cops kills someone they should be fired or put behind a desk taken off the streets etc, good or bad shooting don't matter.. because if its a good shooting a cop is never the same after that anyway!

in ether case he wont have the chance to kill again!

I see. So I assume you feel the same about regular citizens?

If a man with a CCW shoots and kills an intruder, good or bad, he should not be allowed to carry a firearm anymore. He won't have the chance to kill again!!!!!!!

I never said the cop couldn't carry a gun anymore..just not on my dime!

I don't pay the regular citizen to carry a gun! Like I do the cop.

That is the stupidest comment I think I've ever read from you and you usually have some pretty asinine comments.:banghead2:

VM: "We know you have this gun and you might have to use it one day, but if you do use it, know we are either going to fire you or sit you behind a desk for the rest of your life because that gun is actually just supposed to look pretty."

I know a couple cops that have had to use their guns in self defense. Its not something MOST take lightly, but its not something they should be punished for.
