I don’t know much about her.

She hasn’t written many interesting cases since she’s only been on the D.C. Circuit for a short time.

She has the same educational and clerkship chops as other members of the court.

She has a lot of trial-judge experience, which is good. She was a public defender for a while, which is good. The court could use some of that nuts and bolts legal experience, IMO.

Seems like she’s on par with the other 8 in terms of qualifications.

Kagan really didn't have a career as a justice.

There will of course be grades of opposition, main one being the general complaint that it was wrong to narrow the field based on race and gender (code for she's a liberal black female so you better vote GOP in 2022 and 2024).
 
Yeah, but now you got to see how incompetent the democrats are. Inflation out of control, the border out of control, foreign policy out of control, inflation is out of control.
GOP has just as much to blame about inflation and **** foreign policy
 
Good for you, I meant what I said as well. Kagan, for all her qualifications, was almost purely academic in her career.

She was still qualified. Setting her apart from the rest would have insinuated that she is or was unqualified. That would be foolish and make me seem ignorant. That is why I said it the way I did.
 
She was overturned a lot during her time on the district bench.

A lot of her “notable” cases referenced in articles are her siding with labor unions or “resistance” lawsuits. That could just be because the sites that have those profiles up already are pushing to a progressive audience, but it seems like more than that.

Several of those decisions were noted to have been overturned and looking at those specifically, some are things that seem dubious. For example, she issued a nationwide injunction against enforcement of an expedited deportation statute on Administrative Law grounds. But the statute had anti-injunction provision the explicitly prohibited her from doing so. Also, she arguably applied the arbitrary and capricious standard incorrectly in that case, although the Supreme Court started applying it the way she did not long after.

Looks like she got 3 wins in 4 trips to the DC Circuit as an Asst. Federal Defender, which is extremely impressive.

I would be more interested in law review articles or other published works that aren’t memorandum opinions, but I haven’t seen any. I’m sure they’ll come up more, once the hot takes have quieted down.

Based on what little I saw from the report yesterday, she is well spoken and appears to have excellent credentials.

I can’t say anything else about her because I don’t know her track record.

Saying up front that you’re only choosing from a pool of black women discredits her before she’s even picked. The language ahead of the pick should have been “I’m picking the best possible candidate regardless of race or gender “ then pick her if you think she’s the best.

That seems to make sense for everybody given the court’s composition. She doesn’t seem like she’s going to be as effective as Kagan at pulling votes from the other 6. Replacing Breyer with Breyer 2.0 doesn’t seem like something worth fighting over.

Weak as usual…. The general complaint of which you speak is a valid one.
