And a parting note. If you or others want to debate the judicial process or death penalty, evidentiary weight or validity, rape victims protections from their accusers, etc... in general THIS is not the case to stump preach from. This particular kid is guilty as sin regardless how you look at it. The only additional court time he needs is a swift sentencing.

When you find a rabid animal you put it down. Period. Address how the animal got that way next but first thing make sure the rabid animal doesn't hurt anything else.

Our justice system is not based upon the emotional response of the victim's family. That would create a mob mentality. That being said, our justice system is based upon accounting for one actions so I don't agree with most of what Daloth said either.

So do we stop punishing people all together because someone might be innocent? Excepting older cases many of the innocent people getting out were convicted by some pretty da-ning evidence, its not like the state walks in the prosecutor says ' that man is guilty' the judge bangs his gavel and gives him the worst sentence possible. The fact these guys gets out proves the system works, in many countries that doesn't happen, those that do copied our system. If nothing else it is the juries fault, they are the ones to decide most of the time.

Absolutely not. Is your solution that a certain number of innocent people convicted and sent to prison is acceptable as long as some truly guilty people are also sent to prison?
 
I agree with you in general, but not in specific on this case. Rape is one of those hard to prove charges sometimes, as the difference between a yes or a no is the issue at hand. It's not that often that video or text proof exists. Our legal system is set up to err on the side of caution and would prefer to let a guilty man walk than imprison an innocent one.

These guys are guilty as sin though, through the legal book at them and maximum sentence their azzes.

Vigilante justice has no place in our society, and will and should be prosecuted.

I would like to ask one question: how do you know these guys are guilty as sin? If it is based on the jury's conclusion, there is an argument that is tainted by a juror who was completely incapable of objectivity due to her being a victim. Beyond that, have you personally seen the video of the crime, and not just circumstantial tidbits released to the media?

I personally feel these guys are likely guilty, and that the evidence is probably pretty damning, but I refuse to draw conclusions based on what I am told by the government or the media, and not what I know. I do tend to hold the idea of innocent until proven guilty (and all of the intricacies associated with what that really means) pretty dear.

There was a fascinating three part series on HBO about the West Memphis Three called Paradise Lost. It's about a gruesome crime and some kids who were very likely wrongly convicted, with one sent to death row, based on circumstantial evidence, community mob mentality (these kids were different, liked heavy metal, and wore black), etc. For those who have never spent much time actually involved in the legal system, it is a good primer on how quickly the government can do so much wrong trying to do so much right.

What proof do you have she was compromised? Personally I think your whole argument is disingenuous at best, chastising us for drawing conclusions while you draw your own.

And what kind of moron defense attorney in a case like this doesn't have that information prior to trial? Unless due to the nature of the offense her file was blocked then that is sheer ignorance on the defenses part.

If she lied that is one thing. If the panel screening didn't do their job that isn't her fault. And last I checked the jury wasn't on trial here however I guess putting EVERBODY on trial could be an effective delaying tactic!!

There is so much I would like to discuss with you. Your views are incredibly fascinating and I would love to pick your brain about them. But, as many have stated, we are clogging up a message board with off topic discussion.

Vandy got them another diamond in the rough. It wont be long before they start convincing themselves that he will win the Heisman, just because his daddy did.
 
@daj2576 thanks for the offer but I respectfully decline. Nothing personal, I just don't think we would reach consensus on much and I really don't have much more to bring to the debate. We simply don't, and most likely won't, agree. And that's fine. And since I have declined if that offer was specifically to me I would encourage you to edit that post and remove the email addy so as to prevent web crawler harvesting as a minimum.

Back more on point to this thread, I am still amazed that Vandy is ranked ahead of FLA. I don't expect that to hold but still at this late is is absolutely mind boggling.
