Over 135 posts and not one poster grasps what this is really about. One day you will all figure it out, or better yet go read title IX.

If you want to understand what is going on read the pleadings:

Your post has a sanctimonious tone to it. You seem very impressed with yourself. Congratulations but the arguments here have been pertinent to Title IX. Butch Jones' handling of players who have been accused of sexual assault under his tenure is not consistent with the allegations presented in this lawsuit. There was clearly no policy on hand to either condone or shelter football players who were violating the civil rights of female students. There is no evidence based on any published reports (including the extensive and biased reporting of Anita Wadhwani) that there was ever an environment where sexual assaults or harassment was allowed to persist based on any evidence which has been brought to light.

The homosexual rape culture at PSU was a helluva a lot worse than the alleged culture at UT. :yes:

You're 100% correct, however; this doesn't make any type of rape, or how often it happens, okay. One is far too many. Remember, at PSU, the "faithful" didn't want anyone held accountable-as it might hurt their program! I wonder what else they'd sell down the river, for the sake of their program!!!

My point is and will remain that I don't consider it a matter of percentages. EVERY life is valuable. EVERY individual deserves the RIGHT to be considered innocent until proven guilty. I see no reason why one party can remain anonymous and make accusations while the other is held up in public as an accused rapist to suffer the consequences, again, BEFORE he has his day in court. Either both are named or both are anonymous until their day in court. And until that day in court, the men should be allowed to continue living their lives and yes, playing football, working construction, delivering trash, etc. You don't punish until the crime is proven. That's wrong and always will be.

By this, then, you seem to opine that AJ Johnson should NOT have been suspended, should have played out the season, should have graduated, should have gone through the draft and played a year in the NFL?

Because if he HAD, this lawsuit would have merit. Just sayin'.

This will be the next wave of lawsuits filed by plaintiffs attorneys around the country. Watch as school after school is hit with these. And then you might want to ask: Is it reall possible that every school in the country is blatantly fostering an unsafe sexual environment on campus?

I actually agree with this and will up the ante even more. Why in the hell are we using Universities as criminal investigation units in the first place?

That's like getting your oil changed at McDonald's. You should NEVER let an institution police itself. Period.

I just saw something on Facebook about jimmy hyams tweeting that the Vols could face a bowl ban because of the lawsuits. Please tell me the chick that posted that is just fu#$ing with people?

As for your assertion that the lawsuit would have merit if they'd have allowed him to continue on, I find it incomprehensible that one of the most sacred principles in the our criminal justice system, holding that a defendant is innocent until proven guilty is now considered grounds for a lawsuit. Your perverted view of individual freedoms and rights is beyond belief. Typical of the PC crowd....it's always about genitalia. Incredible what a mess our country has become.

Seeing as these players were bounced from the program I'm having a hard time seeing personal culpability for creating an enabling atmosphere for athletes to sexually assault other student with Coach Jones and the athletic department staff. If this alleged policy exists, however, then the administration should absolutely be held responsible--Cheek and Hart in particular.

All that being said, there is NO PLACE at any university for policies that extricate athletes unfairly from criminal behavior. If a player on the team NOW (although I have a feeling the "unnamed current player" is Von Pearson) is named in this lawsuit, then no matter WHO HE IS, he must go. Period.

So you are saying that a player not found guilty, should be booted off team?

I simply find it hard to believe that Butch ,Cheeks and Hart have created a sanctuary that promotes and protects sexual assaults ,which is what is alleged .

What a load of crap thread and lawsuit. We lost some of our best players over "allegations, and no proof."

The administrative law judge who hears the case is appointed by Cheek, the lawsuit says."

The bolded parts are what kill me. These women think the hearings system is unfair because those darn athletes get lawyers and a fair hearing. Terribly doubt these claims succeed. Its bad press for Tennessee, but legally I don't see how they prevail. They'll settle.
 
The lawsuit says those accused of permitting sexual assault should not be able to face their accusers, hire at tourneys, or cross examine the accusers. In other words, these women are saying those accused of sexual assault don't deserve a fair trial or hearing.

The Title IX investigative process is a sham. The schools cannot possibly conduct a legitimate investigation, as they don't have subpoena power. It's nothing more than theatre.

That said, from everything I've read and heard, UT handled it about as well as could be expected. This is not a Baylor situation.

I hope they don't settle and show that they handled best they can. I have not looked into details of title 9, but if what bama writer just posted is true, sounds like title 9 is part of the problem.
