Should the case be settled?

I read another thread (by Volatil I think) about the volunteers at the Alamo, before I clicked this one for the first time.

His thread was about brave men willing to face a superior force while being far outnumbered.
When I first read the OP, I couldn't help but snicker and picture the OP at the
gates explaining -

"Guys, if we just give them what they ask for and offer our watches and rum to boot, we can escape this with minimal damage. Trust me, I'm a lawyer"

No slam OP, just found it funny and thought I would share.

I thought I saw it on here. I shoulda saved it...I'll find it and post.

Also RIP David Douglas

I saw the one going around twitter. To be honest, it was kind of unclear if that is what he was doing or not. I guess you could say that's what it was. If everyone else in the photo was doing the same then I could see how everyone was claiming it. Oddly, he was the only one that was doing anything remotely resembling that.

Search Twitter for Drae Bowles, then pictures. It will come up attached to a tweet right after the bowl game captioned something like "I'm transferring in 2 days swag".

Thanks.

Edit: he only has a pic from 2014 (WITH Peyton Manning :lol). Sumbody been advising. :wink2:

Sorry, I didn't mean to search his account for pictures, I meant put his name in the search bar and then search all of Twitter.

There is one with 3 shots, the last one blowing up only Drae.

Keep scrolling down too and check out the the on the field group shot. This was taken before all of this mess but he doesn't look too unhappy IMO. Odd cast of characters all in the same shot too.

Probably mentioned somewhere, but I guess everyone has read the Tennessean this morning. Now we learn Jenny Wright is consulting with the lawyers and alledged victims. Seems every scorned woman ever to step foot on campus is throwing in with this. No doubt she will be the next media darling and no one will bother to ask about Trae Golden..

I no longer read that trash. But shady witnesses like Wright only help the defense IMO. Bring 'em on.

The Tennessean articles is heavily slanted towards Jenny Wright and very negative about Dave Hart and the football program. It also says her alleged relational with a BB player was proven false.

Settle. Not because it proves the other party right but because it puts the issue to bed. Settle and move on. Hell, we payed Dooley a lot to go away, this can be treated the same way, probably for a cheaper price tag.

Do not settle... if they settle the cloud will forever be hanging over Tennessee's head. Go till the end, whatever that may be.

Just by looking at the amount the plaintiffs will be looking for I don't see how you can settle at this juncture.

It will be long and arduous but I have personally been in a big $ civil case and there are many unknowns. We won I might add but man was it grueling. One can look at the Duke situation that worked out for the positive while J&J got crushed for over $70 mil when it is not even definitely proven talc is a carcinogen so...

One thing I do know is attorneys are flat out coached to keep it out of the hands of a jury.

Condescend much? Start a thread called "Informed Attorney"

As an attorney, I agree with your criticism. Although my own experience does have something to do with my views, my overall opinion is based on just politics of the situation and the benefit of moving on.

I maintain that best course of action is settling.

You may very well be right. My comment was directed at someone who belittled another poster for having an opinion. A lot of people look at things based on idealistic opinion and speak from that. Nothing wrong with that. I do it myself. That part of me says fight it and win. Put those evil people in their place. It's kind of a 'right vs. wrong' scenario. In reality I can't say what actually went on behind the scenes. Just based on everything I've heard, there is at least some merit to the notion that this case is a money grab. Also, even if it is, it will be long and drawn out and very costly. It brings to mind the old Jimmy Stewart movie, "Mr. Smith goes to Washington".

There is no wrong answer.

If we settle it all get swept under the rug and then we can move on.

If we go all the way and give the issue of sexual misconduct the attention it deserves we come out looking like true advocates for women.

To try to prove a culture of rape is an impossible task.

There are just not enough raping going on to show it's part of the culture at UT. When something, when anything is part of a culture, you don't have to beat the bushes(no pun intended) to show examples of what your trying to prove.

Wearing overalls is part of East Tn culture, just like Nascar.

Don't try to prove something as ridiculous as "rape culture", not enough evidence.

I voted to fight it. However I'm leaning toward changing my vote as I didn't realize that Civil trials are won with a majority of jurors voting for the plaintiffs rather than a unanimous decision. It won't be too difficult to get 7 out of 12 that have nasty opinions of athletes, TN football, and men in general or are offended Lady Vol fans. Probably just need to argue the settlement amount down, get some solid language in the agreement that doesn't allow the plaintiffs to continue bashing UT, and get it over with.

Edit: now I hear that Federal civil cases need to be unanimous jury decisions unless the parties agree otherwise. I'm confused. If so... fight the litigants.

No settling! They've thrown boulders at us for the better part of 3 weeks and dragged every big UT name they could through the mud and the the PR damage is already done. The time for settling has passed. If their lawyers had chosen to keep this low key and not orchestrated this 3 week long, coordinated attack I'd be considering a settlement. Not just no, but hell no! Stand your ground at this point and don't give a dime to these pieces of money grabbing crap.
