Not enough time

No he didn't kill anyone out of negligence, the mom that pulled out in front of him did.

How do you know that had he not had the alcohol in his system he could have stopped?

Actually I missed the part that she pulled out in front of him, but he still might have been able to stop had he been sober. These little scenarios can be what if'd to death.

In this case and nobody's but the drivers property was damaged,no charges. BUT and this is a BIG BUT, bigger even than Michelle Obama's, the insurance company should be absolved from any liability.

I can agree with that.

But I am sure that Mutual of Obama wouldn't like that, especially if he needed medical care.

"What if" there actually is two sides to every story? How many undeserving people are screwed royally by our current DUI enforcement over those who are truly in the wrong? The draconian side of your debate would shatter more lives than it protects. This stuff happens every day WITHOUT alcohol involved, placing the blame on one soley because the presence of alcohol in wreckless and unjust.

It can't be stopped. Unless you wanna ban automobiles. How many die in car accidents every day here? regardless of alcohol?.08 is a flat joke. Some one trashed should not be driving, I whole heartedly agree, but that's the minority of the ones who are thrown in jail and stuck with a DUI on record that are stopped every day. DUI is big business, really big business. The easier for them to charge DUI, the more money they can make. Thinking you can just place penalties on something, regardless of severity, is not really a deterrent. See the "war on drugs", it's a huge success right? I've never commited murder, buts it's because of my principles, not the illegality of it. Not once have I said, "If it were legal, I'd kill me some poor guy"

But if he was sober it wouldn't be a question. That instance was only the moms fault.

You never will. Punish drunk crashing severally, if a person is driving reckless regardless of sobriety the punishment should be the same. Our DUI laws are nothing but political fodder and money generators.

On another note. My friend got 15 years for killing 3 illegals with warrants on his only dui. I say he did a favor. The state of Ks thought otherwise.

I will admit to having been mighty tempted a couple times.

they get protests when they do that - cops can have their macho man fun with drunk drivers that kill for all I care

There would be a protest every few minutes then. People are gonna crash and kill people, drunk and sober, just because one has drank doesn't automatically make it their fault in reality, but that's the way the law is written

odds are higher for drunks -- maybe with the popularity of Uber drivers things might get better, who knows though.

As I said before, at what point are you a "drunk". I agree with fact that people who are wasted are prone to accidents. But not the guy who drank three beers and went on home
