No he didn't kill anyone out of negligence, the mom that pulled out in front of him did.
In this case and nobody's but the drivers property was damaged,no charges. BUT and this is a BIG BUT, bigger even than Michelle Obama's, the insurance company should be absolved from any liability.

It can't be stopped. Unless you wanna ban automobiles. How many die in car accidents every day here? regardless of alcohol?.08 is a flat joke. Some one trashed should not be driving, I whole heartedly agree, but that's the minority of the ones who are thrown in jail and stuck with a DUI on record that are stopped every day. DUI is big business, really big business. The easier for them to charge DUI, the more money they can make. Thinking you can just place penalties on something, regardless of severity, is not really a deterrent. See the "war on drugs", it's a huge success right? I've never commited murder, buts it's because of my principles, not the illegality of it. Not once have I said, "If it were legal, I'd kill me some poor guy"
they get protests when they do that - cops can have their macho man fun with drunk drivers that kill for all I care
There would be a protest every few minutes then. People are gonna crash and kill people, drunk and sober, just because one has drank doesn't automatically make it their fault in reality, but that's the way the law is written
