Until there are penalties, serious penalties for making accusations you can't prove, this will happen every time. Regardless of whether he gets confirmed or not, his reputation is permanently tainted and his accuser will cash in on this. She really has nothing to lose and everything to gain.

If it turns out she made it up, he could sue her. Even though he's a public figure, you cannot publicly accuse him a heinous crime you know to be false. Look at Jesse Ventura and the American Sniper dude.

This is a pretty cagey play by Repubs. Whelan didn’t just sit down this afternoon with a six pack and hammer this out. There has to be multiple people doing legwork here. Plus Whelan is apparently a lawyer too? No way he does this without top cover I think.

He could but it may not be something he can prove, just like she can't prove. Plus he would get lambasted in the media for going after her.

Well, if it can't be proven true or false to a suitable degree, your point about there being stiff consequences for false accusations is moot.

That’s why his tweet that you posted caught my eye. The “*at which Kavanaugh was present*” seems like he’s saying something without saying something. And yes he’s an attorney and pretty respected in conservative ranks. That’s why a lot of people don’t believe he would just throw out of bunch of bullsh*t. At the same time he’s good friends with Kavanaugh, so maybe he’s trying his best to defend his friend. Although this wouldn’t be the best way of going about it.

Not really. What if in reality he didn't do it but can't prove it? He can't sue. But if she can't prove it either there should be stiff penalties for making accusations you can't prove.

You can’t tell from the comments. The pro-you must believe her crowd because she said so. Has turned into the gasp, I can’t believe you’d make something like this up man, shame!!

So, anytime a defendant is found not guilty, his or her accuser should be punished?

And if he's confirmed I doubt he would given his position. If he's cleared there's no reason to.

That’s his decision to make. If he views the media hassle to be worth more then restoring his reputation, which in my mind i am fine with him, then that’s on him.
