I think the case could be prosecuted but probably never will.
Was it both parents and why?

JonBenét's was the only murder in Boulder, Colorado, in 1996. The Boulder police had little experience in that type of investigation. Regardless, the majority of them immediately thought that the Ramseys were guilty due to the lack of evidence found indicating that an intruder had broken inside the house, and that the Ramseys had been avoiding the police since the death of their daughter.[citation needed]
Boulder police dismissed the possibility that an intruder had somehow slipped inside the house and committed the murder because they could not find any evidence of anyone breaking in. Instead, District Attorney Alex Hunter leaked information to the media.[citation needed] Meanwhile, the Ramseys had themselves retained a public relations firm and repeatedly appeared on national television to plead their case.
Statements were given to the media by John Ramsey's ex-wife, brother, and sister-in-law. They categorically deny that John Ramsey is, or has ever been, a child abuser. To further defend the claims, John Ramsey's son, John Andrew, and elder daughter, Melinda, told interviewers that their father had always been a loving and gentle person who "cherished" his children and had never abused them in any way. Both children were interviewed as possible suspects in the murder but were later cleared.
In 2004, investigators began to emphasize an intruder theory. Throughout the investigation, the Ramseys maintained their innocence.
Even after the false confession, extradition, and later release of John Mark Karr, JonBenét's murder remains unsolved. Charges have not been filed against anyone.
However, in July 2008 John Ramsey and his late wife Patsy were officially cleared of the death by the Boulder District Attorney's office, based on new DNA evidence collected from JonBenet's clothing; this particular DNA analysis did not exist at the time of the killing.[7]
I know the aforementioned article said they are cleared but the whole situation is ludicrous .
The brother did it and the parents covered it up. The brother spent several years in and out of institutions after the murder.
Always had suspicions about the brother and/or the father together. The ransom note itself seemed like something a middle schooler would write - just bizarro demands i.e. who asks for $118k?? The girl never seemed like a child but more like a carefully shaped plaything for the mother, and maybe the others too.
The case may never be solved officially but somebody somewhere knows something. I remember that freakazoid Karr claiming he did it.

The ransom note was bizarre. One thing that did come out later was the $118,000 was the amount of Christmas bonus John had gotten. What was the purpose of the note and how did it fit into the case? Did you ever read the note? The brother Burke never made sense as a suspect. He was too young.
That is a theory I've thought of before but the examiner stated that Jon Benet was hit with enough force to fell a full grown man. I just have a hard time believing a 9 year old did that. Yes, I agree too that Patsy is the least likely suspect. If you believe there was an intruder you have to totally discount what the police believe about an intruder but of course they bungled the case entirely. Then you have John Ramsey's children from previous marriage and his ex-wife who state he was a devoted and loving father and a gentle man. If Burke bashed her skull how does the note, the strangulation, and the 911 call play into it?Did not remember the $118k was John's bonus. So long I have forgot a lot of details.

A possible scenario i thought was JB was being abused, the brother either saw this accidentally or was intentionally included as a player in the abuse. He attempted to imitate what he saw, JB resisted. He had a fit of rage. Young kids even at age 9 can do a lot of damage.
But this suggests the authorities didn't bungle the whole thing to begin with. Add politics and a moneyed white enclave, who knows what went on in that house for years.
Didn't the note match Patsy's handwriting? And wasn't there strong speculation that the mom killed her because the little girl wet her bed?
