I hope not. I know there are circumstances but I just can't get excited about a coach that got fired by another SEC school. We're a bigger program than that. At least we were until last weekend.

No....sadly we are not bigger than that. National commentators use us for laughs, we have to get our rep back and only a proven winner like Les have the stones to do it. Jeez...I love UT as much or more than anyone, but you have to look at reality...we are damaged goods at the moment.
 
Not so fast...Schiano may well file a Defamation of Character lawsuit saying Tennessee's failure to honor a verbal MOU leading to false acquisitions about what he knew or didn't know about Jerry Sandusky's actions at PSU cost him millions in salary and hurt his chances to get another HC position at another school. UT would probably have to settle out of court and drop another couple of million.
Verbal? There are numerous reports it was signed by both Schiano and Currie. We will definitely settle. You can't risk losing in court and having to pay Schiano over 20 million. I'm thinking we will settle for around 5 million. We also owe Currie 5 million (100 grand per month), so we pissed away 10 million that could've been used on a buyout for a quality coach. It was the buyout that prevented us from hiring Brohm reportedly. The idea that Currie was fired for cause is also a reach. You can't fire an athletic director for cause simply for disobeying a crooked booster.

This is not me spewing anything...this was mentioned by the media that Schiano was contemplating legal action against the failure to honor the MOU because of reaction to something that may have happened at PSU. I guess we will see if this comes to anything.

Currie alone can’t bind the University. The MOU was never fully executed and therefore is not binding. The defamation stuff is a non-starter. UT did nothing to defame him and as a public figure the standards are much higher regarding grounds. Schiano would essentially have to prove UT did so with malice then he would have to prove actual damages which considering that he hasn’t lost any other income at this point seems unlikely. Again UT did nothing to defame him so it’s a moot point. The only possible scenario that I can see where UT might have an issue would be where Currie held himself out as having authority to bind the University and Schiano relied upon that and turned down another job. I think there’s no way that happened and even if it did UT wins. Plus if Currie did do that then UT has cause in the Currie firing situation which takes care of his buyout. All this is assuming that the MOU wasn’t executed by Davenport and DiPietro but I haven’t read a single credible account that either signed. This is of course my opinion based on the alleged facts as I understand them.

A legally binding MOU with UT, using Butch and Rick Barnes MOUs as reference, requires more than just Currie and Schiano's signatures in order to be fully executed.

There's no legal grounds to sue because the other parties refused to sign and execute an mou.

It still does not meet the legal requirements for 'defamation of character', and any lawyer who Schiano talks to, will tell him the same.

remember Les was fired for not willing to make changes in his staff when it wasn't working..but if hired we'd have to hire a game clock coordinator

That has not been the opinion of lawyers consulted by various reporters about the MOU. The ONLY sources saying UT won't be financially responsible are those employed by UT. It won't go to court. We'll settle. 4 to 5 million is the consensus.

Who are these lawyers? Let's here some sources who are going to go on record and state that an MOU, missing two signatures is the equivalent of a signed contract.

That’s pretty much the reason why he got fired.

Can he step away from his offensive philosophy to improve UT or does he want to be like Butch and control everything?

Geez get over it already. Like you don’t have to worry what night of the week Kiifin would bail out again. Les Miles would be fine. I’d love to interview any member of VN that keeps bringing that up on Miles that is looking for a job due to having lost one.

Find me one contract lawyer who will go on record and say that an MOU missing two signatures carries the same weight and consequence as a fully executed employment contract.

You act like UT legal counsel is just going to roll over because a sports analyst said they will owe Schiano money.

Still have beer left so, be diligent in that search.
