Levels of Due Process by Status
U.S. Citizens: Possess the full spectrum of constitutional protections, including the right to a trial by jury in criminal cases, protection against arbitrary government actions, and full rights to enter and reside in the country.
Lawful Permanent Residents (Green Card Holders): Have significant due process rights similar to citizens, particularly regarding deportation. They are entitled to a hearing before an immigration judge to challenge removal and can apply for relief.
Undocumented Immigrants/Non-citizens in the U.S.: Entitled to fundamental due process, including the right to a fair hearing, the right to hire a lawyer at their own expense, and the right to present evidence. However, in certain scenarios, such as apprehension at the border or expedited removal, their due process rights are significantly restricted compared to citizens.
