Hypothetical - would Tennessee take him back?

At the same time none of us know what type of offers Nico did have in the winter transfer portal. He may have very good reason to ask for more money, or maybe not. Maybe 4 mil was just the starting point of negotiations, but Tennessee never moved off of the 2.4 mil they supposedly they agred to in December.

The bottom line is that the excuse that there wasn't enough done in the transfer portal holds weight, whether true or not, becuase Tennessee didn't add much premier talent. We added a backup WR and a 3 star RB from Duke.
And 2 guards that will start. Signed a 5 star tackle.
 
I assume you are saying there should have been a remedy for non-performance in the Spyre/Nico contract. I've written and/or administered hundreds of contracts and none of them had a remedy for non-performance. Of the two legal disputes we had, we won them both, one with a summary judgement issued by the presiding judge before we went to trial (he determined the defendant didn't have a case) and the other when, after depositions, the opposing attorney realized he didn't have a winnable case.
I'm referring to payment structure, whether they're paying out monthly, quarterly, or annually. If anything but annually, then the contract reduces exposure for non-performance/lack of deliverables.

Stewart Mandel at The Athletic has reviewed a contract between a collective and a five-star Class of 2023 recruit that would pay him more than $8M. Both are unnamed in the story, but Mandel says the contract would pay the recruit $350,000 almost immediately, “followed by monthly payouts escalating to more than $2 million per year once he begins his college career, in exchange for making public appearances and taking part in social media promotions and other NIL activities ‘on behalf of (the collective) or a third party.’”

It’s not that it’s cold blooded, but this has garnered a lot of national attention with most being on Tennessee’s side. We’d look ridiculous if we let him back after all the antics like no-showing for practice. Nico wasn’t very good anyway, and you can tell his dad he isn’t welcome on campus, but you can’t end their relationship and expect that Nic wouldn’t still be telling the kid what to do.
The No Show/No Communication was the unbridgeable line for me…and I’d imagine his former teammates and coaches. Don’t burn em if you ever envision walking on em again.

We also lost 2 solid interior OL, so it's only a slight upgrade to the OL as a whole. Either way, there was not enough done at the skill positions, especially considering the number of guys we lost.
 
If Nico, not his dad or agent, called CJH today and apologized would Tennessee take him back?

Would Tennessee put stipulations on welcoming him back like, your dad can no longer manipulate our success and thus has to “stay away?”

Would the team welcome him back? Would he need to go on an apology tour?

I ask this bc I believe Tennessee did the right thing, however, this is still not an ideal situation. I’m sure we all were excited to see Nico with his 3rd year in the system and 2nd year as a starter take massive leaps in progress. And before you answer, I’m as annoyed by this as anyone but it’s a dagger to lose your QB roughly 4 months before the season kickoff.

Not even if they offered a refund on what they had been paid.
 
Iamaleava’s original plan was to declare for the NFL Draft after the 2025 season—after all, his NIL contract ran until Dec. 2025, the family friend said. But now, he’ll start over at another program. Iamaleava had not yet announced a commitment, though he reportedly entered the transfer portal Wednesday with a “do not contacttag, suggesting he had made a decision.

 
With the added drama where he asked for more to play against OSU on top of what just happened there’s no way in hell he could ever come back.

You seem to think it was about improving his draft status. How is that working out. No matter what he does for what college team, NFL teams are going to grill him about sitting out until he got more money.

To be honest it was about more money for him. If he was really worried about better talent around him, reduce your NIL payments that could be used for better players. This better player crap is just what his team came up with to try and cover their ass.

If you think TN did the right thing, then why would you want them to look stupid and let him come back. He tried to be bigger than the program, ghosted the coaching staff and threw the middle finger at his teammates because of money. 1 more year at TN and he would have had all the money he wanted after being drafted.

Whatever happens now is irrelevant. Of course this all backfired on him and looks terribly from the putside.

It doesn't mean he wasn't under the impression that he was trying to improve his contract and/or get better talent around him. Both can be true. They aren't independent of each other. But it also could very well be that Nico thought he was getting paid under market value, was somewhat fine with it if the money "saved" would be allocated towards adding more skill players, then being dissappinted by what skill players we actually acquired and wanting what he thought was his market value.

Regardless if his stock drops or he doesn't get paid the same money, doesn't mean he didn't have valid offers in the Winter window that justified his thought process.

Having written some really complicated contracts, I believe I could write a contact that would bind a player to an area (via required public appearances), not a school, for a period of time, making it nearly impossible to sign with another school.

For example: Collective is compensating [Player name] for up to [x number of] public appearances, memorabilia signings and social media promotions at Knoxville area locations to be determined by the Collective. Whereas Collective expects the value of Player's NIL to increase in value each year, Compensation for such appearances earned will be $1M in year 1, $2M in year 2 and $5M in year 3. Whereas Player desires uniform monthly payments, Collective will prepay Player for such services as follows: $2M at time of signing and $2M each year for 3 years to be paid in equal monthly installments.
