I realize that most of you will immediately be dismissive of it, because it's taken from "The Lawrence O'Donnell Show" on MSNBC, and he is a Trump-hating, devout liberal.
Between the :08 and the :50 second mark, a pundit named Bradley Moss, who is identified by a chyron as being a "National Security Attorney," states that documents pertaining to our own nuclear weapons would fall under a law known as "The Atomic Energy Act," and would therefore, have a separate classification regime, which Donald Trump could not declassify on his own. It is "The Atomic Energy Act" which is always cited by the pundits I see arguing that the President can't declassify nuclear secrets all by himself.
Now, once again, and by my own admission ... I know nothing about this. I'm not arguing with you. I'm merely posting information that conflicts (slightly) with what you are saying.
Ok so wait a minute. I didn’t go google anything but this person might be referring to DOE clearances vs DOD clearances. For example a DOE Q clearance I think parallels to DOD Secret? Admittedly guessing here.
And if that’s the case I’ll still stand pat as I don’t think it passes muster that Congress can simply legislate their own classification system and exclude the executive branch. That simply doesn’t pass the sniff test.
