There are some legal nuances here that represent new grounds, I believe. I think the likelihood of success by CA depends on how narrowly they focus.

They better get to a pinpoint. The judges ruling is asinine. It's not whether the CiC has the authority to federalize a NG unit, the question is what can he use them for. The judge basically ruled that the president didn't have the authority to call up the NG for federal service.

These things move fast so I could be behind but hasn't that ruling already been halted? I don't think it's been effectively fully overturned yet (which I'm thinking will happen, at least as presently ruled) but certainly for now the NG use is still considered legal, correct?

Yep, it's been stayed by a higher court.

If Biden did this in Tennessee, y'all would be up in arms. So many state's rights advocates here... Suddenly and conveniently silent.

Rule of Law upheld for now, albeit postponed. I suspect CA will ultimately prevail as well... The devil's in the details.

CA will not prevail in this even though Trump is wrong. The reason CA will not prevail is that there lawsuit is too broad in claiming POTUS doesn’t have the authority to activate the NG.

The CA AG cannot be that stupid so we have to assume that this is just another liberal stunt to get publicity. If they would have simply claimed Trump can’t federalize its NG and use them for riot control they would have a slam dunk case.
