A smart lawyer could likely make a compelling argumentI don’t think the commerce clause actually gives the Fed the power to directly force I think it’s more of a carrot/stick approach. They can use the commerce clause to punish them for not doing their bidding. That is the stick in the DPA.
But I think that’s basically the same thing. Adding/removing barriers. I don’t think the Fed can say “start putting out chicken/pork/beef or you’re going to jail” but they can say “your meat processing capacity is hereby deemed essential and by the regulations outlined in the Defense Protection Act you are hereby ordered to open operations back up or be subject to the sanctions outlined in the DPA.”It gives them the ability to remove barriers to movement of goods. The DPA isn't in the Constitution.But I’d guess the DPA gives him the authority to declare the food supply essential if he choses to try to force them to stay open.

All the levers are pull now for the government to take over and demand any business to do its bidding . There’s a national emergency in play , the war powers act is in play , there is only one more thing it can do and that’s declare martial law . How do you not know this ?

I think you’re crossed on your particular government overreach which applies lilreb. The War Powers Act actually puts limits on POTUS with regards to committing military forces to combat without congressional concurrence. The Defense Protection Act allows the Feds to direct the supply chain and production but doesn’t outright nationalize private industry the companies are paid for their efforts and products which the Feds have ordered them to produce.Our government has a tremendous amount of power but certain levers have to be pulled in order for it to override states rights . These levers go up in strength National emergency , War powers act , and then the “Mack daddy “ Martial law . We really really need to keep them from pulling that last lever . The war powers act is bad enough , but that last one is full on , full throttle power . I don’t think any of us wants any president to be in full control of a country.
