At least 17 Capitol riot defendants now 'effectively without counsel' with high-profile attorney John Pierce in hospital

“In a filing Monday, the DOJ said attorney John Pierce, of the California-based firm Pierce Bainbridge, had been out of contact and had missed multiple court hearings since August 23. An associate, Ryan Marshall, who has been appearing in Pierce’s place told a judge last week he believed Pierce was “ill with COVID-19, on a ventilator, and unresponsive,” according to the DOJ.”

“Compounding the issue, the DOJ says, is the fact that Marshall – who has been appearing in Pierce’s stead and even attended an evidentiary meeting with prosecutors – is not a licensed attorney. He’s also facing felony charges in two separate cases in Pennsylvania, including one case involving his “alleged participation in a conspiracy to commit fraud while clerking for a judge on the Pennsylvania Court of Common Please, according to the DOJ.”

“A few hours later, Mr. Marshall attended a reverse-proffer session with a different defendant represented by Mr. Pierce, telling the Assistant U.S. Attorney that he had just gotten word that Mr. Pierce had been in an accident and was on his way to the hospital,” the filing said.

“After that information was reported publicly, a different individual reached out to an NPR correspondent and wrote that Mr. Pierce did not, in fact, have COVID, but instead ‘was hospitalized on Monday due to symptoms that he believed might be related to Covid-19’; ‘appears to have been suffering from dehydration and exhaustion’; and ‘remains under the care of his doctors,’ ” the filing said.

Couple other amateur hour elements to this story, but this seems like enough to be going on with.

Not sure who looks worse here, Marshall, a wannabe attorney (like several here on VN), or the DOJ and court system for allowing a fake attorney to act like a real one.

Unless something else has come out since that story, it’s Pierce and his firm, without question, followed closely by Marshall and then the people that were calling these defendants political prisoners in a not so distant third.

Pierce is expected (and in some places ethically required) to have somebody competent prepared to step in in the event of prolonged disability. He’s a member of a firm of some sort; at a bare minimum a licensed attorney should have been ready to take over his practice in that event.
