So my uncle has an upgrade available and he is happy with his non-data phone. If he upgrades to the i5 and then turns it off and gives it to me no harm no foul?
I have no issue paying the cost. We are not on the same account that may pose a problem for me.
The phone subsidy is worked into the contract. If you sign a new 2-year contract, they don't care what device you actually use on the account. Buy a phone and sell it. They have you for 2 years, they don't care.
The problem you may run into is buying the iPhone 5 and the phone plan he has. Not sure how all carriers work but you may run into a situation where he must have XX plan to actually get the iPhone. As mentioned above, this is because the subsidy of the phone is worked into the price of the plan.
Have an upgrade you haven't used for years? The carriers love you. You are paying the subsidy they charge anyway and not buying a new phone at less than wholesale price.

Music plays fine, sound is turned all the way up, I've checked online and have done all of the troubleshooting tip, and I haven't dropped my phone. Oh and I've also rebooted it. Anyone have any ideas other than it's defected somehow (even though it worked fine a few months ago)?

How are you watching them? YouTube app? Browser? Watch ESPN? Other app?
The YouTube app is no longer supported with iOS6 and watching in the browser is recommended.
