“Slam dunk” probably wasn’t accurate, the more I think about it. There are definitely some other crimes going on here, but it would come down to which crimes the state enumerates. In Tennessee, I think kidnapping is the closest fit. Tennessee instructions and law on kidnapping are really favorably to the state, but I imagine everybody’s initial response to that is a bit of side eye.

Yes, always thought of felony murder in the scenario of someone robbing a gas station, and then shooting the clerk during the commission of the robbery - “felony” murder.

Irrespective of whether there are predicate crimes to trigger a felony murder charge, does this look more like 1st or 2nd degree in your opinion?

Whether he had it or not, do you think it was smart to carry a gun to a "protest"? I won't argue the legality, because I support the 2A. What was the purpose of carrying it? Was he going to "defend" himself against federal agents? How'd that work out for him?

No luther, it was just plain retarded to have had a gun with him, legal or not. ESPECIALLY if he was going to get in the trenches and mix it up with them.
