The Deportation of Kilmar Armando Abrego Garcia

According to the petition filed by Jennifer Vasquez on August 3, 2020, in the District Court of Maryland for Prince George’s County, Garcia verbally abused her, kicked her, slapped her, shoved her, mentally abused her kids, locking them in their bedroom while they cried, and detained Vasquez against her will.
In November 2019, Vasquez alleges that Garcia grabbed her by the hair while in a vehicle. In December 2019, she states Garcia grabbed her from her hair in the car and dragged her out of the vehicle--abandoning her in the street. In January 2020, Vasquez claims Garcia broke her son’s tablet and broke doors in their house. In March 2020, she alleges that Garcia pushed her against the wall while breaking phones and TVs.

This newly released petition was filed in 2020, prior to the petition Vasquez filed against Garcia 2021. In that filing, Vasquez claimed he bruised, punched, and scratched her while ripping off her
This paints a pretty clear picture as does the trafficking evidence... but it's all just icing on the cake that he already had a valid deportation order from 2019

I gather you're educated but I think you're unfamiliar with a few basic legal tenants here in the United States.

The first is habeas corpus. This is a fundamental legal right and court order that protects individuals from unlawful imprisonment, requiring the government to present a prisoner and justify the detention before a judge. This right of Garcia was violated by DHS. If you don't like that Garcia is afforded the writ of habeas corpus, then you similarly have no objections to you, personally, being arrested and imprisoned in the future without any cause, right to a hearing or legal process.

The second is due process. This is a course of formal proceedings (as judicial proceedings) carried out regularly, fairly, and in accordance with established rules and principles. Garcia's right to due process was violated in multiple ways including his deportation to El Salvador despite a court order prohibiting this, illegal detention, vindictive prosecution, and now coercion.

The third is the fifth amendment. The Fifth Amendment guarantees due process for all persons in the U.S., including undocumented immigrants. Your suggestion that Garcia has no rights to due process, therefore, is simply wrong.

Look, I understand that you *think* that guys like Garcia are guilty until proven innocent and should be instantaneously deported, but that's not how the legal system works. Trump and his goons have played loose and fast with the law to fulfill his campaign promises, but the judicial branch is catching up with him and holding that many of his actions have violated the law. Not only with Garcia, but also with all the folks Trump illegally deported to El Salvador and Venezuela.

Again, you may not like it, but persons residing here in the US have basic legal rights... and for good reason.

Anyone who believes that lawgator is well versed on legal or any other subjects is a dang fool. Even a broken clock is right twice a day, but in my VN history lawgator has never ever been correct. Whatever legal advice that lawgator gives do the opposite. Whatever ever predictions that he makes bet the opposite. If lawgator tells you that a tsunami will never occur in Illinois then pray for Illinois because a tsunami will soon occur.

He was found to be in violation of law, if they had deported him years ago the rest of the charges and accusations wouldn't be taking place. It would appear that listening to counsel is potentially making this worse for him.

He was either beating his wife or more, or she is doing something wrong. Matter of fact, she should have been telling him to go back home.

The domestic abuse accusations indeed have never been proven. His being in the country illegally and having a valid deportation order however are no disputable. So the other charges are secondary. He isn’t staying.
 


I am sorry but how can he get deported to Uganda? I can understand sending him back to his home country, El Salvador, but Uganda? If Trump is that desperate to get this guy out of the country, all he needs to do is have El Salvador make an official request for his extraditing. There is nothing a USA court could do about that as he is a citizen of El Salvador and by treaty we would have to return him.
